HomeMy Public PortalAbout08438 O R D I N A N C E NO. 8438 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the State of Missouri, acting by and through the Missouri Highway and Transportation Commission, certain unimproved real property of the District in St. Louis County, Missouri for the site of State Highway Department facilities, and prescribing the terms of said transaction. WHEREAS, Resolution No. 1902, adopted August 9, 1989, declared said real property as surplus, and WHEREAS, the State of Missouri, acting by and through the Missouri Highway and Transportation Commission, requires said real property of the District for the site of State Highway Department facilities, and is empowered to acquire same through the exercise of eminent domain, and WHEREAS, the District is willing to sell and convey said real property to the State of Missouri, acting by and through the Missouri Highway and Transportation Commission, for such public use, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized and directed to sell and convey to the State of Missouri, acting by and through the Missouri Highway and Transportation Commission, certain unimproved real property of the District is St. Louis County, Missouri for the site of State Highway Department facilities for the total sale price of Five Hundred Seven-four Thousand Dollars ($574,000.00), said real property being described as follows: All right, title and interest in and to the following two (2) parcels of land, as set out by deed recorded in Book 7021, Page 1108. Parcel No. 1: Part of Lot 4 of the Jones and Harriett Bassett Farm, according to the plat thereof recorded in Plat Book 4, Page 34 of the St. Louis County recorder's Office, described as: Beginning at the Northwest corner of said Lot 4; thence South 89 degrees 44 minutes 24 seconds East along the North line of said Lot 4, 986.36 feet to a point in the Southwest line of Barrett Station Road, 40 feet wide, thence along said Southwest line of Barrett Station Road South 17 degrees 04 minutes 24 seconds East 14.10 feet, South 21 degrees 41 minutes 56 seconds East 302.92 feet and South 25 degrees 25 minutes East 284.14 feet to a point; thence North 89 degrees 44 minutes 24 seconds West parallel to the North line of said Lot 4, 1,139.66 feet to a point in the West line of said Lot 4; thence North 8 degrees 45 minutes West along said West line of Lot 4, 557.35 feet to the point of beginning, according to Survey by Roland Horton and Son in May, 1951. Parcel No. 2: Part of Lot 5 of the Jones and Harriett Bassett Farm, according to the plat thereof recorded in Plat Book 4, Page 34 of the St. Louis County Recorder's Office, described as: Beginning at the Northwest corner of Lot 4 of said Bassett Farm; thence North 8 degrees 24 minutes West, 520.25 feet to a point; thence North 80 degrees 55 minutes East, 212.09 feet to a point; thence North 0 degrees 12 minutes West, 253.04 feet to a point in the South line of Manchester Road; thence along the South line of Manchester Road North 80 degrees 55 minutes East 3.13 feet to a point and North 79 degrees 57 minutes East, 36.87 feet to a point; thence leaving said road line and running South 0 degrees 12 minutes East 464.48 feet to a point; thence South 8 degrees 24 minutes East, 350.56 feet to a point in the South line of said Lot 5; thence North 89 degrees 09 minutes 04 seconds West 223.812 feet to the point of beginning. Said two (2) parcels contain 16.4 acres, more or less, of land. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above. The foregoing Ordinance was adopted July 9, 1991.
