HomeMy Public PortalAbout08439 O R D I N A N C E NO. 8439 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the City of Des Peres, Missouri certain unimproved real property of the District in St. Louis County, Missouri for the construction of a box culvert over Sugar Creek as a part of the realignment and reconstruction of Dougherty Ferry Road by the City of Des Peres, Missouri and St. Louis County, Missouri, and prescribing the terms of said transaction. WHEREAS, the real property hereinafter described is hereby declared as surplus in that it is no longer necessary or useful in the operations of the District, and WHEREAS, the City of Des Peres, Missouri requires said real property of the District for the construction of a box culvert over Sugar Creek as a part of the realignment and reconstruction of Dougherty Ferry Road by the City of Des Peres, Missouri and St. Louis County, Missouri, and is empowered to acquire same through the exercise of eminent domain, and WHEREAS, the District is willing to sell and convey said real property to the City of Des Peres, Missouri for such public use, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized to sell and convey to the City of Des Peres, 2 Missouri certain unimproved real property of the District in St. Louis County, Missouri for the construction of a box culvert over Sugar Creek as a part of the realignment and reconstruction of Dougherty Ferry Road by the City of Des Peres, Missouri and St. Louis County, Missouri, for the total sale price of One Dollar ($1.00), said real property being described as follows: Two (2) parcels of land in the Southeast Quarter of Section 4, T44N, R5E, being portions of a tract of land conveyed to the Metropolitan St. Louis Sewer District, a Corporation by deed recorded in Book 4226, Page 393 of the St. Louis County, Missouri, Recorder's Office, and are more particularly described as follows: PARCEL 1 All that portion of said Metropolitan St. Louis Sewer District property lying West of the West line of Dougherty Ferry Road, 40 foot wide (as traveled) and being more particularly described as follows; BEGINNING at the Southwest corner of said Metropolitan St. Louis Sewer District property, said point being distant South 77 degrees 07 minutes West a distance of 301.00 feet, from the East line of said Section 4 as measured along the South line of said Metropolitan St. Louis Sewer District property, and as shown on a survey by Lapin and Dabler Engineers and Surveyors dated October 10, 1959, said point also being in the Centerline of Dougherty Ferry Road as described and recorded in Parcel 3 by deed in Book 4112, Page 268 of said Recorder's Office; thence along said centerline of Dougherty Ferry Road, North 16 degrees 56 minutes East a distance of 135.96 feet to its intersection with the West line of Dougherty Ferry Road, 40 foot wide (as traveled); thence along said West line of Dougherty Ferry Road, 40 foot wide (as traveled), South 11 degrees 20 minutes West a distance of 38.78 feet, thence continuing along said West Line, South 2 degrees 46 minutes West a distance of 85.77 feet to its intersection with the aforementioned South line of property conveyed to the Metropolitan St. Louis Sewer District by deed recorded in Book 4226, Page 393; thence along said South line, South 77 degrees 07 minutes West a distance of 28.55 feet to the point of beginning and containing 1,436 square feet more or less. 3 PARCEL 2 Commencing at the Southwest corner of said Metropolitan St. Louis Sewer District property as conveyed by deed and recorded in Book 4226, Page 393 of said Recorder's Office, said point being distance South 77 degrees 07 minutes West a distance of 301.00 feet, from the East line of said Section 4 as measured along the South line of said Metropolitan St. Louis Sewer District property, and as shown on a survey by Lapin and Dabler Engineers and Surveyors dated October 10, 1959, said point also being in the centerline of Dougherty Ferry Road as described and recorded in Parcel 3 by deed in Book 4112, Page 268 of said Recorder's Office; thence along said South line of said Metropolitan St. Louis Sewer District property as conveyed by deed and recorded in Book 4226, Page 393 of said Recorder's Office, North 77 degrees 07 minutes East a distance of 70.09 feet to THE ACTUAL POINT OF BEGINNING, said point being in the East line of Dougherty Ferry Road, 40 foot wide (as traveled); thence along said East line of Dougherty Ferry Road, 40 foot wide (as traveled), North 2 degrees 46 minutes East a distance of 72.03 feet to its intersection with the South line property conveyed to St. Louis County by deed recorded in Book 8817, Page 1686 of said Recorder's Office; thence along said South line of said St. Louis County property and its eastward prolongation, North 73 degrees 03 minutes 33 seconds East a distance of 90.80 feet; thence leaving said South line, South 12 degrees 52 minutes 57 seconds East a distance of 75.78 feet to its intersection with the aforementioned South line of property conveyed to Metropolitan St. Louis Sewer District by deed recorded in Book 4226, Page 393 of said Recorder's Office; thence along said South line, South 77 degrees 07 minutes West a distance of 110.00 feet to the point of beginning and containing 7,246 square feet, more or less. NOTE: All bearings for Parcels 1 and 2 have been rotated to conform with the bearings specified in said deed recorded Book 8817, Page 1686 of said St. Louis County Recorder's Office. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above. 4 The foregoing Ordinance was adopted July 9, 1991.
