HomeMy Public PortalAbout08445 O R D I N A N C E NO. 8445 AN ORDINANCE, vacating portions of sewer easements in part of Lot 11 of The Commons of the Town of St. Ferdinand, Township 47 North, Range 6 East, in the City of Florissant, St. Louis County, Missouri. WHEREAS, the owner of the subject property has agreed to grant to the District suitable alternate easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The portions of sewer easements described below are hereby vacated, to wit: Three parcels of land located in part of Lot 11 of The Commons of the Town of St. Ferdinand, Township 47 North, Range 6 East, in the City of Florissant, St. Louis County, Missouri. Parcel 1 being a portion of a fifteen (15) foot wide easement recorded in Deed Book 6716, Pages 1729 and 1730 of the St. Louis County records. Parcel 2 being a ten (10) foot wide easement recorded in Deed Book 6716, Pages 1729 and 1730 of the St. Louis County records. Parcel 3 being a portion of a ten (10) foot wide easement recorded in Deed Book 7306, Pages 916 and 917 of the St. Louis County records. Parcel 1 - Commencing at the southwestern corner of a tract of land conveyed to Zykan Brothers Investments, Incorporated, as per instrument recorded in Deed Book 6296 on Page 813 of the St. Louis County records; thence North 00 degrees 20 minutes 57 seconds West a distance of 77.92 feet; thence North 49 degrees 30 minutes 11 seconds East 26.17 feet to the point of beginning of the easement to be vacated; thence along the center line of a 15.00 foot wide easement the following courses and distances, North 49 degrees 30 minutes 11 seconds East a distance of 313.75 feet; thence South 89 degrees 33 minutes 44 seconds East a distance of 141.32 feet to the end of said 15.00 foot wide easement Parcel 2 - Commencing at the southwestern corner of said tract of land as conveyed to Zykan Brothers Investment, Incorporated, as per instrument recorded in Deed Book 6296 on Page 813 of the St. Louis County records; thence North 00 degrees 20 minutes 57 seconds East a distance of 292.86 feet; thence North 89 degrees 33 minutes 44 seconds West a distance of 59.48 feet; thence North 7 degrees 53 minutes 16 seconds East a distance of 7.56 feet to the point of beginning of the easement to be vacated; thence along the center line of a 10.00 foot wide easement the following courses and distances; North 7 degrees 53 minutes 16 seconds East a distance of 196.63 feet; thence South 89 degrees 52 minutes 10 seconds East a distance of 910.06 feet to a point in the 100 foot wide Coldwater Creek right-of-way; thence North 73 degrees 53 minutes 48 seconds East a distance of 50.37 feet to the end of said 10.00 wide easement. This vacation does not affect the Coldwater Creek Drainage Right-of-Way 100' wide. Parcel 3 - Commencing at the southeastern corner of a tract of land conveyed to Zykan Brothers Investments, Incorporated, as per instrument recorded in Deed Book 5244 on Page 372 of said St. Louis County records; thence North 89 degrees 56 minutes 00 seconds West a distance of 65.35 feet to the center line of a 10.00 foot wide easement, said center line being the point of beginning of the easement to be vacated; thence along the center line of the 10.00 foot wide easement the following courses and distances, North 32 degrees 37 minutes 20 seconds West a distance of 107.93 feet; thence North 45 degrees 36 minutes 07 seconds West a distance of 316.56 feet to the end of said 10.00 foot wide easement. The foregoing Ordinance was adopted July 9, 1991.
