AN ORDINANCE, appropriating One Hundred Six Thousand
Dollars ($106,000.00) from the Improvement Fund to be used for the
project costs for the construction of sanitary sewers in
Subdistrict No. 634 (Maryalan Court) in St. Louis County,
Missouri, and
AN ORDINANCE, confirming a contract with Fred M. Luth &
Sons, Inc. for the construction of sanitary sewers in Subdistrict
No. 634 (Maryalan Court), in St. Louis County, Missouri, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Eighty-nine Thousand Twenty-five and 50/100 Dollars
($89,025.50), and the costs of engineering, survey, inspection,
construction staking, advertisement costs, easement charges,
connection fees, allowance for construction change orders, and
processing and administration of tax bills is Sixteen Thousand
Nine Hundred Seventy-four and 50/100 Dollars ($16,974.50), and
WHEREAS, proceedings have been taken for the
construction of sanitary sewers in Subdistrict No. 634 (Maryalan
Court), Fifty-three Thousand Dollars ($53,000.00) of said
construction costs is to be paid for by special tax bills or other
evidence of special benefit assessments upon the land benefited by
such improvement.
WHEREAS, St. Louis County, Missouri, pursuant to the
Housing and Community Development Act of 1974, has agreed to
contribute Fifty-three Thousand Dollars ($53,000.00) toward the
total costs of said project; upon the receipt of such funds from
said source, said money will be returned to the Improvement Fund,

WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Hundred Six Thousand
Dollars ($106,000.00) is hereby appropriated from the Improvement
Fund to be used for project costs for the construction of sanitary
sewers in Subdistrict No. 634 (Maryalan Court), in St. Louis
County, Missouri pending payment into the Improvement Fund of the
costs hereby appropriated in aid from any source, and from the
proceeds of collection of special benefit assessments levied, or
special tax bills issued, to pay a portion of such costs.
Section Two. The contract heretofore let by the
Executive Director to Fred M. Luth & Sons, Inc. as the lowest
responsible bidder for the construction of sanitary sewers in
Subdistrict No. 634 (Maryalan Court), in St. Louis County,
Missouri, with The Metropolitan St. Louis Sewer District, pursuant
to bids received and opened on the 11th day of July, 1991 and
formally executed on the 13th day of August 1991 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
