AN ORDINANCE, appropriating Seven Hundred Twenty
Thousand Dollars ($720,000.00) from the Clean Water Capital
Improvement Trust Fund to be used for project costs for the
construction of the Bissell Point Watershed Overflow Regulation
System Central Sewer Rehabilitation (BP-07B, 91120B), in the City
of St. Louis, Missouri; and confirming a contract with Fred M.
Luth & Sons, Inc. for the construction of the aforesaid project,
in compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of the Bissell
Point Watershed Overflow Regulation System Central Sewer
Rehabilitation is Six Hundred Eighty-six Thousand One Hundred One
Dollars and Eighty-five cents ($686,101.85) and the allowance for
change orders is Thirty-three Thousand Eight Hundred Ninety-eight
Dollars and Fifteen cents ($33,898.15), and
WHEREAS, pursuant to Section 7.120 of the Plan of the
District, the appropriation effected herein will not result in a
deficit at the end of the current budget year,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Seven Hundred Twenty Thousand
Dollars ($720,000.00) is hereby appropriated from the Clean Water
Capital Improvement Trust Fund to be used for project costs for
the construction of the Bissell Point Watershed Overflow
Regulation System Central Sewer Rehabilitation (BP-07B, 91120B),
in the City of St. Louis, Missouri.

Section Two. The contract heretofore let by the
Executive Director to Fred M. Luth & Sons, Inc. as the lowest
responsible bidder for the construction of the Bissell Point
Watershed Overflow Regulation System Central Sewer Rehabilitation
(BP-07B, 91120B), in the City of St. Louis, Missouri, with The
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 22nd day of October, 1991 and formally executed
on the 5th day of November, 1991 by said contractor and by the
Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 11, 1991.
