HomeMy Public PortalAbout2008.130 (08-05-08)RESOLUTION NO. 2008.130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DIRECTING THE DIRECTOR OF NEIGHBORHOOD SERVICES TO ABATE THE iVUISANCE OF DRY AND DYING WEEDS ON CERTAIN PARCELS OF LAND IN THE CITY OF LYNWOOD FOR FISCAL YEAR 2008-2009 WHEREAS, on July 1, 2008 the City Council of the City of Lynwood adopted Resolution No. 2008.109 relating to the abatement of dry and dying weeds, stubble, brush, litter or other flammable materials, on certain parcels of land in the City listed on Attachment "A"; and WHEREAS, due notice, a sample of which is attached as Attachment "C", was given to the owner of record to destroy such weeds pursuant to the provisions of Sections 39560-39588 of the Government Code; and WHEREAS, notice of this public hearing in the form attached as Attachment "B" was given to the owner of each property at issue; and WHEREAS, the City Council of the City of Lynwood has considered all of the facts and is fully informed in the matter, and has acquired jurisdiction to proceed and perform the work of removal of said nuisances. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Lynwood does hereby find, proclaim, order and resolve as follows: SECTION 1. The above recitals are true and correct and incorporated herein. ~ SECTION 2. That any objection presented to said City Council are hereby overruled after review and due consideration, and that the Director of Neighborhood Services is hereby instructed to abate the nuisance where the property owner was duly notified for each of the properties described in Attachment "A" attached herewith and incorporated herein. The Director of Neighborhood Services and his/her designees are hereby expressly authorized to enter upon private property for said purpose. SECTION 3. That any property owner shall have the right to have any such nuisance removed and abated at his/her own expense, provided that such works is done prior to the time that work is commenced by the City. No charge shall be made by the City of Lynwood if the City does not perform the work; otherwise, the City of Lynwood will collect the costs of said work through a special assessment as permitted by law. SECTION 4. This Resolution shall become effective immediately upon its adoption. PASSED, APPROVED and ADOPTED this 5t" day of August, 2008. Maria T.
