HomeMy Public PortalAbout08572 O R D I N A N C E NO. 8572 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to B.B.C. Corporation, Inc., certain real property of the District located in St. Louis County, Missouri, and prescribing the terms of said transaction. WHEREAS, the real property hereinafter described has been declared as surplus pursuant to Resolution No. 1903, and WHEREAS, pursuant to Resolution No. 2016, adopted the 18th day of September, 1991, said real property was appraised, publicly advertised for sale and will be sold to the highest bidder for same, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized and directed to sell and convey to B.B.C. Corporation, Inc., certain real property of the District located in St. Louis County, Missouri for the total sale price of Two Hundred and One Thousand ($201,000.00), said real property being described as follows: A parcel of ground being part of lots 75 and 76 of Sigerson Nursery Tract in Block 6 of CARONDELET COMMONS, South of the River des Peres, together with the Southwest 10 feet of Roosevelt Avenue, vacated by order of the St. Louis County Court, recorded in Book 354, Page 155 of the St. Louis County Records, all in Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the most Western corner of said Lot 75; thence North 36 degrees 27 minutes 50 seconds East 2 168.81 feet along the Northwest line of Lot 75 to the Southeast line of Interstate Route 55, as conveyed by deed recorded in Book 4443, Page 33 of the St. Louis County Records; thence North 50 degrees 37 minutes 50 seconds East 387.32 feet along the Southeast line of said Interstate Route 55 to an angle point therein; thence continuing along said Southeast line North 56 degrees 54 minutes 30 seconds East 614.18 feet to the Southwest line of Roosevelt Avenue, 50 feet wide; thence South 53 degrees 59 minutes 30 seconds East 360.39 feet along the Southwest line of said Roosevelt Avenue to the North line of the Missouri Pacific Railroad right of way, 100 feet wide; thence South 76 degrees 23 minutes 08 seconds West 278.36 feet along the North line of the Missouri Pacific Railroad right of way to a point of curve; thence continuing along said North line in a Westwardly direction 203.25 feet along a curve to the left, having a radius of 1,436.19 feet to the most Eastern corner of property described in deed to Clinton R. Schattgen, recorded in Book 6398 Page 1341 of the St. Louis County Records; thence South 79 degrees 14 minutes 38 seconds West 300.00 feet along the North line of said Clinton R. Schattgen property to its Northwest corner; thence South 19 degrees 34 minutes 50 seconds East 88.35 feet along the West line of said Clinton R. Schattgen property to the Northwest line of the Missouri Pacific Railroad right of way, 100 feet wide; thence in a Southwestwardly direction 484.04 feet along a curve to the left, having a radius of 1,482.39 feet to the Northeast line of Mount Olive Road, 30 feet wide; thence North 54 degrees 01 minutes 00 seconds West 153.82 feet along the Northeast line of said Mount Olive Road to the point of beginning, and containing 216,006 Square Feet or 4.959 Acres, more or less. Also, a strip of land twenty (20) feet wide, being a portion of Roosevelt Avenue (formerly Paule Avenue), fifty (50) feet wide (formerly sixty (60) feet wide), lying in part of the Sigerson Nursery Tract, a part of Blocks 5 and 6 of Carondelet Commons, recorded in Plat Book 5, Page 79 of the City of St. Louis (formerly County) Records, Township 44 North, Range 6 East, in St. Louis County, Missouri, said Roosevelt Avenue (50 feet wide) was vacated by instrument recorded in Book 8365, Page 2057 of the St. Louis County Recorder's Office, and said twenty (20) foot wide strip is more particularly described as follows: A strip of land twenty (20) feet wide being the southwestern twenty (20) feet of said vacated Roosevelt Avenue (50 3 feet wide), bounded on the northeast by a line being 5.00 feet southwestwardly of and parallel to the centerline of said Roosevelt Avenue (50 feet wide), bounded on the southeast by western line of Avenue "I", bounded on the southwest by the northeastern line of property conveyed to the Metropolitan St. Louis Sewer District by deed recorded in Book 7341, Page 1753 of the St. Louis County Recorder's Office, said northeastern line being the southwest line of said Roosevelt Avenue (50 feet wide), and bounded on the northwest by eastern right-of-way line of Interstate Route 55. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above, and further to deposit the proceeds from said sale and conveyance in the reserve for Real Property Purchase, Improvement and Alterations Account. 4 The foregoing Ordinance was adopted January 8, 1992.
