HomeMy Public PortalAbout08577 O R D I N A N C E NO. 8577 AN ORDINANCE, vacating portions of sewer easements in Lots 11, 12 and 13 of Pointe Essex in the City of Kirkwood, in St. Louis County, Missouri. WHEREAS, the owner of the subject property has requested the District to vacate said sewer easements, and this District has no further use for said easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The portions of sewer easements described below are hereby vacated, to wit: Three parcels of land located in Lots 11, 12 and 13 of Pointe Essex as recorded in Plat Book 274, Page 8 of the St. Louis County Records. The three parcels being portions of a ten foot (10') wide easement recorded in Deed Book 1786, Pages 483 to 485 of the St. Louis County Records. Parcel 1 Commencing at an old iron pipe, said pipe also being the North corner of Lot 11 of Pointe Essex Subdivision as recorded in Plat Book 274, Page 8, St. Louis County, Missouri records; thence along the North line of the above mentioned Lot 11, South 61 degrees 52 minutes 13 seconds East 87.01 feet to a point at the intersection of the North line of the above mentioned Lot 11, with the West line of an existing 10 foot wide easement as recorded in Book 1786, Pages 483-485 of the St. Louis County, Missouri records. Said point also being the true point of beginning. Thence continuing along said North line, South 61 degrees 52 minutes 13 seconds East, 10.00 feet to a point; thence leaving said property line, South 28 degrees 40 minutes 10 seconds West 44.47 feet to a point; thence north 87 degrees 28 minutes 10 seconds East 37.14 feet to a point on a 30 foot easement line; thence South 28 degrees 07 minutes 47 seconds West 11.63 feet along said 30 foot easement to a point; thence leaving said 30 foot easement line, South 87 degrees 28 minutes 10 seconds West 35.05 feet to a point; thence South 02 degrees 50 minutes 50 seconds East 58.58 feet to a point on the above mentioned 30 foot easement line; thence South 28 degrees 07 minutes 47 seconds West 7.66 feet along said 30 foot easement to a point; thence along a curve to the left with a radius of 295 feet, an arc length of 12.20 feet and a chord bearing South 26 degrees 56 minutes 51 seconds West, to a point; thence leaving 2 said 30 foot easement line, North 02 degrees 50 minutes 50 seconds West 82.17 feet to a point; thence North 28 degrees 40 minutes 10 seconds East 54.66 feet to the point of beginning. Parcel 2 Commencing at an old iron pipe, said pipe also being the North corner of Lot 12 of Pointe Essex Subdivision as recorded in Plat Book 274, Page 8, St. Louis County, Missouri records; thence along the North line of the above mentioned Lot 12, South 61 degrees 52 minutes 13 seconds East 58.85 feet to a point; thence South 28 degrees 07 minutes 47 seconds West 5.00 feet to a point at the intersection of the South line of a five foot easement, as recorded on the above mentioned Pointe Essex Subdivision plat, with the West line of an existing 10 foot wide easement as recorded in Book 1786, Pages 483-485 of the St. Louis County, Missouri records. Said point also being the true point of beginning; thence South 61 degrees 52 minutes 13 seconds East 10.00 feet, along the South line of said 10 foot easement, to a point; thence South 28 degrees 40 minutes 10 seconds West 97.51 feet to a point on the South line of the above mentioned Lot 12; thence along the South line of said Lot 12, North 61 degrees 52 minutes 13 seconds West 10.00 feet to a point; thence leaving said lot line,North 28 degrees 40 minutes 10 seconds East 97.51 feet to the point of beginning. Parcel 3 Commencing at an old iron pipe, said pipe also being the West corner of Lot 13 of Pointe Essex Subdivision as recorded in Plat Book 274, Page 8, St. Louis County, Missouri records; thence along the South line of the above mentioned Lot 13, South 61 degrees 52 minutes 13 seconds East 58.95 feet to a point; thence North 28 degrees 07 minutes 47 seconds East 5.00 feet to a point at the intersection of the north line of a five foot easement, as recorded on the above mentioned Pointe Essex Subdivision plat, with the West line of an existing 10 foot wide easement as recorded in Book 1786 Pages 483-485 of the St. Louis County, Missouri Records. Said point also being the true point of beginning; thence North 28 degrees 40 minutes 10 seconds East 108.68 feet to a point on the South line of a 30' easement; thence South 88 degrees 45 minutes 50 seconds East 10.36 feet along said easement to a point; thence South 01 degree 14 minutes 10 seconds West 1.75 feet to a point; thence leaving said 30 foot easement South 28 degrees 40 minutes 10 seconds East 111.80 feet to a point on the North line of the aforementioned 10' wide easement; thence North 61 degrees 52 minutes 13 seconds West 10.00 feet along the North line of said easement to the point of beginning. 3 The foregoing Ordinance was adopted January 8, 1992
