AN ORDINANCE, appropriating Forty-five Thousand Eight
Hundred Dollars ($45,800.00) from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek to be used for
project costs for the construction of storm sewers in Glade Ave.
#2907-2909 (87087) in the City of Jennings, Missouri; and
confirming a contract with Bommarito Construction Company for the
construction of the aforesaid storm sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, said project is part of St. Louis County,
Missouri's $5 Million Stormwater Bond Issue Program, and
WHEREAS, Ordinance No. 6994, adopted March 11, 1987,
authorized the District's participation in said Program, and
WHEREAS, the bid for the construction of said storm
sewers is Thirty-six Thousand Four Hundred Fifty-six and 60/100
Dollars ($36,456.60), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Nine Thousand Three
Hundred Forty-three and 40/100 ($9,343.40), and
WHEREAS, St. Louis County, Missouri has agreed to pay
Twenty-two Thousand Nine Hundred Dollars ($22,900.00) toward the
total costs of said project; upon the receipt of such funds from
said source, said money will be returned to the Operation,
Maintenance and Construction Improvement Fund of Maline Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund

sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Forty-five Thousand Eight
Hundred Dollars ($45,800.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of Maline
Creek to be used for project costs for the construction of storm
sewers in Glade Ave. #2907-2909 (87087), in the City of Jennings,
Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bommarito Construction Company as the lowest
responsible bidder for the construction of storm sewers in Glade
Ave. #2907-2909 (87087), in the City of Jennings, Missouri, with
The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 13th day of February, 1992 and formally
executed on the 10th day of March, 1992 by said contractor and by
the Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Four. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted March 11, 1992.
