AN ORDINANCE, appropriating Two Hundred Sixty-one
Thousand Six Hundred Dollars ($261,600.00) from the Operation,
Maintenance and Construction Improvement Fund of Watkins Creek to
be used for project costs for the construction of storm sewers in
Coal Bank Road #1014 Phase II (85006), in St. Louis County,
Missouri; and confirming a contract with Bates Utility Company,
Inc. for the construction of the aforesaid storm sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Two Hundred Eighteen Thousand Eight Hundred Fourteen
Dollars ($218,814.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Forty-two Thousand
Seven Hundred Eighty-six Dollars ($42,786.00), and
WHEREAS, the State of Missouri has agreed to contribute
Eighty-five Thousand Dollars ($85,000.00) toward the total costs
of said project; upon the receipt of such funds from said source,
said money will be returned to the Operation, Maintenance and
Construction Improvement Fund of Watkins Creek, and
WHEREAS, St. Louis County, Missouri has agreed to
contribute Eighty-five Thousand Dollars ($85,000.00) toward the
total costs of said project; upon the receipt of such funds from
said source, said money will be returned to the Operation,
Maintenance and Construction Improvement Fund of Watkins Creek,
and

WHEREAS, certain property owners being served by said
project have agreed to contribute Five Thousand Seven Hundred
Dollars ($5,700.00) toward the total costs of said project; upon
the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction
Improvement Fund of Watkins Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Sixty-one Thousand
Six Hundred Dollars ($261,600.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Watkins Creek to be used for project costs for the construction of
storm sewers in Coal Bank Road #1014 Phase II (85006), in St.
Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the construction of storm sewers in Coal
Bank Road #1014 Phase II (85006), in St. Louis County, Missouri,
with The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 13th day of February 1992 and formally
executed on the 10th day of March, 1992 by said contractor and by
the Executive Director and Secretary-Treasurer on behalf of the

District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
