AN ORDINANCE, appropriating Ninety-seven Thousand
Dollars ($97,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Gravois Creek to be used for
project costs for the construction of a gabion wall in Emergency
Repair No. 12 Gravois Creek Trunk Sewer East of Burlington R.R.
(92061) in St. Louis County, Missouri; and confirming a contract
with Bates Utility Co., Inc. for the construction of the aforesaid
gabion wall, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said gabion
wall is Seventy-nine Thousand One Hundred Seventy-five Dollars
($79,175.00), and the cost of engineering, inspection,
construction staking, and allowance for construction change orders
is Seventeen Thousand Eight Hundred Twenty-five Dollars
($17,825.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Ninety-seven Thousand Dollars
($97,000.00) is hereby appropriated from the Operation,
Maintenance and Construction Improvement Fund of Gravois Creek to
be used for project costs for the construction of a gabion wall in
Emergency Repair No. 12 Gravois Creek Trunk Sewer East of

Burlington R.R. (92061), in St. Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Co., Inc. as the lowest
responsible bidder for the construction of a gabion wall in
Emergency Repair No. 12 Gravois Creek Trunk Sewer East of
Burlington R.R. (92061), in St. Louis County, Missouri, with The
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 10th day of March, 1992 and formally executed on
the 11th day of March, 1992 by said contractor and by the
Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
