AN ORDINANCE, appropriating a total of One Hundred
Eighteen Thousand Five Hundred Dollars ($118,500.00), to be funded
as follows: Seventy-two Thousand Two Hundred Dollars ($72,200.00)
from the Operation, Maintenance and Construction Improvement Fund
of Deer Creek and Forty-six Thousand Three Hundred Dollars
($46,300.00) from the Operation, Maintenance and Construction
Improvement Fund of Black Creek, to be used for the rebuilding
and/or replacing inlets, manholes, inlet manholes, and replacing
sewer pipe in Infrastructure Repair Number 047 (92017), in the
Cities of Brentwood, Clayton, Creve Coeur, Des Peres, Glendale,
Kirkwood, Maplewood, Olivette, Richmond Heights, Shrewsbury,
University City, Webster Groves, Westwood, and/or unincorporated
St. Louis County, Missouri; and confirming a contract with D.
Bennish Construction Company, Inc. for the aforesaid project, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the aforesaid project is One
Hundred Two Thousand Six Hundred Fifty Dollars ($102,650.00), and
the cost of engineering, inspection, construction staking,
advertisement costs, and allowance for construction change orders
is Fifteen Thousand Eight Hundred Fifty Dollars ($15,850.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named funds
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:

Section One. The sum of One Hundred Eighteen Thousand
Five Hundred Dollars ($118,500.00) to be funded as follows:
Seventy-two Thousand Two Hundred Dollars ($72,200.00) from the
Operation, Maintenance and Construction Improvement Fund of Deer
Creek and Forty-six Thousand Three Hundred Dollars ($46,300.00)
from the Operation, Maintenance and Construction Improvement Fund
of Black Creek, is hereby appropriated to be used for the
rebuilding and/or replacing inlets, manholes, inlet manholes, and
replacing sewer pipe in Infrastructure Repair Number 047 (92017),
in the Cities of Brentwood, Clayton, Creve Coeur, Des Peres,
Glendale, Kirkwood, Maplewood, Olivette, Richmond Heights,
Shrewsbury, University City, Webster Groves, Westwood, and/or
unincorporated St. Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to D. Bennish Construction Company, Inc. as the
lowest responsible bidder for rebuilding and/or replacing inlets,
manholes, inlet manholes, and replacing sewer pipe in
Infrastructure Repair Number 047 (92017), in the Cities of
Brentwood, Clayton, Creve Coeur, Des Peres, Glendale, Kirkwood,
Maplewood, Olivette, Richmond Heights, Shrewsbury, University
City, Webster Groves, Westwood, and/or unincorporated St. Louis
County, Missouri, with the Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 27th day of February,
1992 and formally executed on the 28th day of April, 1992 by said
contractor and by the Executive Director and Secretary-Treasurer

on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
