AN ORDINANCE, appropriating Forty-seven Thousand Eight
Hundred Twenty-five Dollars ($47,825.00) from the Operation,
Maintenance and Construction Improvement Fund of Deer Creek to be
used for project costs for the construction of storm sewers in
Julian Place #400 Block (90102), in the City of Kirkwood,
Missouri; and confirming a contract with Gershenson Construction
Company, Inc. for the construction of the aforesaid storm sewers,
in compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Thirty-six Thousand Four Hundred Eleven Dollars
($36,411.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Eleven Thousand Four
Hundred Fourteen Dollars ($11,414.00), and
WHEREAS, the City of Kirkwood, Missouri has agreed to
contribute Twenty-three Thousand Nine Hundred Twelve and 50/100
Dollars ($23,912.50) toward the total costs of said project; upon
the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction
Improvement Fund of Deer Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:

Section One. The sum of Forty-seven Thousand Eight
Hundred Twenty-five Dollars ($47,825.00) is hereby appropriated
from the Operation, Maintenance and Construction Improvement Fund
of Deer Creek to be used for project costs for the construction of
storm sewers in Julian Place #400 Block (90102), in the City of
Kirkwood, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Gershenson Construction Company, Inc. as the
lowest responsible bidder for the construction of storm sewers in
Julian Place #400 Block (90102), in the City of Kirkwood,
Missouri, with The Metropolitan St. Louis Sewer District, pursuant
to bids received and opened on the 30th day of March, 1992 and
formally executed on the 28th day of April, 1992 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
