Call to Order Chair Kittrell called the meeting to order at 10:00 a.m. 2. Approval of previous meeting minutes from January 26,2017. The meeting minutes were approved. 3. Code review progress updates from the subcommittee chairs and vice chairs a. The Building and Energy Conservation code committee started its review of Chapters 16, 17 and 18. Special guests were invited. Dave Weber(structural engineer)discussed Columbia's action on these chapters. Bruce Dawson (geotechnical engineer)supplemented the discussion from his viewpoint about special structural inspections. b. The Existing Building committee is through the code book and is ready to present their draft bill. Discussions may continue on the definition of"historic locally." c. The Mechanical, Fuel Gas,and Energy code committee is ready to review a draft ordinance. d. The Residential and Energy Conservation code committee bill is ready for review. e. The Fire and Property Maintenance code review is through Chapter 34. Discussed what Columbia did to put sprinklers into fraternities and sororities. 4. Old Business—review timeline of proposed bills for code adoption The schedule was reviewed and revised. It is attached to the minutes. 5. Review proposed bills for adoption of the 2015 IMC and IFGC The draft bills were reviewed and approved unanimously by the committee. 6. New Business none 7. Public Comments No public comments were made. 8. Next Meeting Date? "'March 9th? The next meeting date will be on the 20th of March 2017. The timeline revision eliminated meeting every two weeks. Also, it was requested by JCFD to meet on March 20th since they will have a special guest visiting that day for the City Council to advocate sprinklers. 9. Adjourn The meeting adjourned at 11:40 am. Section 116—compare against Dangerous building city code sections Page 2 of 4 New Building Code Proposed Timeline As a planning guide, below is a proposed timeline for the approval process of the adoption of the new building codes. Overview In general, the technical sub-committees will make recommendations to the Steering Committee. Upon code adoption approval by the Steering Committee, a public comment period will be held that includes 2 to 3 public forums. After any adjustments, the proposed ordinances will then be submitted to the City Council by city staff for their consideration and possible approval. Since this is an Ad Hoc Committee made by resolution, all meetings are public and will have time allocated for public comments within their agendas. Codes under consideration for adoption: A. 2014 National Fire Protection Association (NFPA) 70 or the National Electric Code (NEC) B. 2015 International Code Council (ICC) versions: 1. International Fire Code (IFC) 2. International Residential Code (IRC) 3. International Building Code (IBC) 4. International Existing Building Code (IEBC) 5. International Plumbing Code (IPC) 6. International Mechanical Code (IMC) 7. International Fuel Gas Code (IFGC) 8. International Property Maintenance Code (IPMC) 9. International Swimming Pool and Spa Code (ISPSC) 10. International Wildland-Urban Interface Code (IWUIC) 11. International Energy Conservation Code (IECC)* 12. International Green Construction Code (IGCC)* 13. ICC Performance Code (ICCPC)* *- potentially will not be adopted The adoption of the new codes will need to be in at least two (2) bills—one for City Code Chapter 8 (Buildings and Building Regulations) and the other for Chapter 13 (Fire Prevention and Protection). The IFC is administered by the Fire Department and the remaining codes by Planning and Protective Services Department. May-June— Hold public comment meetings July 10, 2017— Introduce bills into City Council agenda. August 7, 2017—Approval of pending adoption bills New Codes Effective date—60 days after approval of City Council Rev February 24,2017 Thursday, February 16, 2017 Sec.8-27 Adoption of the 2015 International Existing Building Code The 2015 International Existing Building Code, published by the International Code Council, Inc., is hereby adopted and incorporated herein by reference as the existing building code of the City of Jefferson,Missouri with the additions,insertions,deletions and changes contained within this ordinance. Sec.8-28 Amendments The following additions, insertions, deletions and changes are made to the 2015 International Existing Building Code,otherwise referred to herein as the existing building code of the City of Jefferson: Section 101.1: Insert the words"City of Jefferson"as the name of jurisdiction. Section 103: Department of Building Safety Delete Sections 103.1 thru 103.3,and insert the following in its place: Section 103.1: CREATION OF ENFORCEMENT AGENCY The department of building safety known as the Department of Planning and Protective Services is hereby continued and the executive official in charge thereof shall be known as the Director of Planning and Protective Services. Wherever the words code official appears in this code, it shall mean the Director of Planning and Protective Services or his or her designee. Section 103.2: APPOINTMENT The Director of Planning and Protective Services shall be appointed and removed is provided by ordinance. Section 103.3: DEPUTIES The Director of Planning and Protective Services shall recommend to the City Administrator the employment of building inspectors in sufficient numbers to assure enforcement of the existing building code. Section 105.2 Work exempt from permit—add the following under the"Building"portion: "7. Non-structural building envelope repair work for existing structures covered under the International Residential Code—one and two family dwellings." Section 108.7 Add this section: "Section 108.7 Fee Schedule. The fees for building construction permits shall be set in Appendix Y of the City Code of the City of Jefferson." Section 112 BOARD OF APPEALS—replace this section with the following: Section 112.1 Appeals. Any owner,agent or other person shall have the right to appeal a decision of the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection,alteration or repair of work covered by this code. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted,the provisions of this code do not fully apply,or an equivalent form of construction can be used. The appeal shall be to the circuit court of Cole County as established in Article 536 of the Revised Statutes of Missouri. Rev. 1/27/2017 1 Section 113 VIOLATIONS Delete Section 113.4 and insert in lieu thereof the following: Section 113.4 Violation Penalties. Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who repairs or alters or changes the occupancy of a building or structure in violation of the approved construction documents or directive of the code official or of a permit or certificate issued under the provisions of this code, shall be punished by a fine of not less than $100 or more than $500 or by imprisonment not exceeding 180 days,or both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense. Section 116.6 Hearing—delete this section Section 702.4 Window opening control devices.—Delete in the main paragraph"and one-and two-family dwellings and townhouses regulated by the International Residential Code" Section 708 ENERGY CONSERVATION—delete section Section 811 ENERGY CONSERVATION—delete section Section 908 ENERGY CONSERVATION—delete section Section 1002.1 Compliance with the building code. Modify the last sentence of the first paragraph to"..., the building or only the affected portion of the building shall comply..." Section 1012.8 Accessibility.Change"shall"to"should"in the first sentence. Section 1 106 ENERGY CONSERVATION—delete section Section 1401.2 Applicability. — Change the first sentence to read "Existing structures in which there is work..." Section 1401.2.5 Accessibility.Change"shall"to"should" Rev. 1/27/2017 2 Thursday, February 16, 2017 Sec.8-21 Adoption of the 2015 International Residential Code The 2015 International Residential Code, for One and Two Family Dwellings, published by the International Code Council, including Appendix J, is hereby adopted and incorporated herein by reference as the residential building code of the City of Jefferson, Missouri with the additions, insertions, deletions and changes contained within this this ordinance. Sec.8-22 Amendments The following additions, insertions, deletions and changes are made to the 2015 International Residential Code,for One-and Two-Family Dwellings otherwise referred to herein as the Residential Building Code of the City of Jefferson: Section RI01.1: Insert the words"City of Jefferson"as the name of jurisdiction. Section R105.2 Work Exempt from Permits Replace RI05.2. item # 2, (fences not over 7 feet high) with "Non-structural building envelope repair work for existing structures." Section R108 FEES Add sections R108.7 and RI08.8 to this section: R108.7 Fee Schedule.The fees for building construction permits shall be set in Appendix Y of the City Code for the City of Jefferson. R108.8 Fee for penalty for failure to obtain a building permit. Where work for which a permit is required by this Code is started prior to obtaining said permit,the fees specified in Appendix Y of the Code of the City of Jefferson shall be doubled. Should any person,firm or corporation commit a second offense by starting work without permit after so doing on a previous occasion, he shall pay three times the customary fee in order to obtain the necessary permit. Any offense shall subject the offender to prosecution under section 116.4. In the event any person firm or corporation fails to obtain the necessary permit(s) within 5 days after being notified in writing to do so by the Code official, he shall pay in addition to the usual fee or increased penalty as provided above the sum of$25.00 for each day in excess of the aforesaid 5 days that transpire prior to his or her obtaining the necessary permit. The payment of any or several of the above stated penalty fees shall not relieve any person, firm or corporation from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed Thursday, February 16, 2017 herein. Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the building official,or of a permit or certificate issued under the provisions of this code,shall be punished by a fine of not less than $100 or more than $500,or by imprisonment not exceeding 180 days,or both such fine and imprisonment.Each day that a violation continues shall be deemed a separate offense. Section RI 14.2 Delete this section and insert in lieu thereof the following: Section RI 14.2 Unlawful Continuance. Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a minimum fine of$100 plus$25 for each day of the unlawful continuance. Section R302.11 —delete item"4"(fire blocking around vents,pipes,etc.) Section R302.13—add the following exceptions: "5.Open-web wood truss floor joists with draft stopping per 1,000 square feet." Thursday, February 16, 2017 "6.Closed-web wood joists with one(1)hour fire treating." Section R303.6—Add the following: "Exception:. Bathroom exhaust fans may be exhausted into a soffit vent if composed of approved materials as determined by the Building Official." Figure R307.1 —Add the following: "Water closet: All water closets shall be spaced at least fifteen (15) inches from the centerline of the fixture to any wall or plumbing fixture,except the centerline of the water closet may be spaced twelve(12)inches if located next to a bathtub/shower unit." Section R309.5—delete section—garage sprinklers are required if walls are built to Table R302.1 (2) Section R31 1.7.5.1 —add exception "3.Closed risers are not required on exterior stairs where the riser is less than 10'above grade." Section R312.2—delete section—window fall protection Section R313.1 —delete-townhouse fire sprinkler Section R313.2—delete—One and Two family sprinklers Section R313.3—add the following per Section 67.281.1 RsMO: "A builder of one or two family dwellings or townhouses shall offer to any purchaser,on or before the time of entering into the purchase contract,the option at the purchaser's cost to install or equip an automatic fire sprinkler system in the dwelling or townhouse. Notwithstanding any other provision of the law to the contrary, no purchaser of such a one or two family dwelling or townhouse shall be denied the right to choose or decline an automatic fire sprinkler in such dwelling or townhouse being purchased." Section R314.4—replace a portion of the first sentence of 2nd paragraph: "Exception: Interconnection of smoke alarms in existing areas may use wireless technology or shall not be required..." Section R403.1.3.3 — Delete seismic categories. This will require steel reinforcement in turned-down footings. Section R404.4—Replace"48 inches"with"9 feet"and replace"24 inches"with"5 feet." Section R602.3.1 -Add the following sentence to the end of Exception number 2: "Alternatively, 2"x 6"No. 2 grade studs supporting a roof and floor load with not more than 10' of tributary length shall have a maximum stud height of 14'." Chapter 11 —Energy Efficiency—use the 2009 version of this chapter in lieu of the 2015 version. Section 107.5 Stop work orders: —replace a portion the last sentence(..shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars.)with"...shall be liable for penalities specified in Section 107.4."
