AN ORDINANCE, appropriating Forty-five Thousand Five
Hundred Dollars ($45,500.00) from the Operation, Maintenance and
Construction Improvement Fund of Deer Creek to be used for project
costs for the construction of a gabion wall in Creekwood Lane #2
(90269) in the City of Ladue, Missouri; and confirming a contract
with R.V. Wagner, Inc. for the construction of the aforesaid
gabion wall, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said gabion
wall is Thirty-three Thousand Nine Hundred Eighty Dollars
($33,980.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs and
allowance for construction change orders is Eleven Thousand Five
Hundred Twenty Dollars ($11,520.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Forty-five Thousand Five
Hundred Dollars ($45,500.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of Deer
Creek to be used for project costs for the construction of a
gabion wall in Creekwood Lane #2 (90269), in the City of Ladue,
Missouri.

Section Two. The contract heretofore let by the
Executive Director to R.V. Wagner, Inc. as the lowest responsible
bidder for the construction of a gabion wall in Creekwood Lane #2
(90269), in the City of Ladue, Missouri, with The Metropolitan St.
Louis Sewer District, pursuant to bids received and opened on the
9th day of April, 1992 and formally executed on the 28th day of
April, 1992 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
