PRESENT: Chairman Melanie Shirling, Member Roy Hobbs, Member Dee Johnson, Member John Lott, Member Jake Lindsay and Clerk Shara Roberts. ABSENT: Member Bette Lovinus. VISITORS: Kevin Murray, Sandy Elrengler, Vee Gibson, Lamar Stucki, and Stanley Gilgen Chairman Melanie Shirling welcomed everyone and Member Roy Hobbs led with the Pledge of Allegiance. Minutes Approved: Member Dee Johnson moved to approve the Planning & Zoning (P&Z) Minutes of September 9, 2015 with the change of manufactured to mobile in the second to last paragraph under the discussion of the amended plat located at 5287 East Owens Avenue. Member Roy Hobbs seconded the motion. All were in favor, motion carried. Bob & Melanie Hart — Variance Application for Amended Plat located at 5287 East Owens Avenue — Public Hearing — 6:30 pm: Chairman Melanie Shirling welcomed the public and explained the public hearing process. Kevin Murray introduced himself as representing Bob & Melanie Hart in the matter up for discussion. Mr. Murray is with Keller Williams realty and is located at 3525 Merlin Drive, Idaho Falls, ID 83404. Mr. Murray explained that their proposal consists of splitting the lot into two separate 1 /3 acre lots. The front lot would have 80.25 feet of frontage, and the rear lot would have 100 feet of frontage. The proposal includes a flag lot with a 20 foot easement. Mr. Murray explained based on his experience in real estate, property with access off the alley typically doesn't sell as well, and that is why the Mr. & Mrs. Hart opted to do a flag lot and request a variance for the minimum frontage requirements. Chairman Melanie Shirling opened the hearing up for public comment, and asked for individuals present who supported the variance application. No public responses. Chairman Melanie Shirling asked for individuals present who were neutral towards the variance application. Resident from the floor approached the stand and introduced himself as Stanley Gilgen located at 5265 Owens Avenue. Mr. Gilgen explained he doesn't necessarily want a house there, but understands the reasoning behind the amended plat. He stated if you are going to grant a variance though you should grant a variance off the alley, and referenced Jerry Hansen's property in which a similar thing was done. Mr. Gilgen expressed his frustrations that the City hasn't done anything with the maintaining of the alley in years. He stated "the City has forgotten that alley exists and it's used extensively." Mr. Gilgen would like the City to do something with the alley, and that is his main grievance. Mr. Gilgen stated "if you are going to grant a variance do it right." 1 Member Dee Johnson clarified that Mr. Gilgen would rather have alley access to the back lot opposed to the flag lot access. Mr. Gilgen verified this was correct. Member Jake Lindsay explained that City Code doesn't require a variance application for access to a lot, but rather the variance was needed for the minimum frontage requirements. Mr. Gilgen explained in all his years of living here it was his understanding that in order to build off an alley you needed to get a variance. Member Dee Johnson read the alternative solution to a flag lot provided in the letter by the City engineer Scheiss & Associates. The letter read "the developer could eliminate the flag lot access to Iona Road for Lot 3-A, make flag lot portion of 3-A part of Lot 3-B with a 20 foot wide utility easement through the same area for water and sewer services for Lot 3-A. This would allow Lot 3-B to have more than 85 feet of frontage, thus eliminating the need for a variance and require Lot 3-A to take its access in the alley which is okay." Member Dee Johnson explained the reason for the variance request was based on meeting the minimum frontage requirements not on access to the lots. Member Roy Hobbs explained on the Jerry Hansen property it was part of the negotiations on the access for emergency vehicles, and that is recorded in the minutes. He explained that has the project develops and progresses it was agreed they would have the alley widened to 20 feet and paved. Chairman Melanie Shirling asked for individuals present who were opposed to the variance application. No public responses. Chairman Melanie Shirling asked Mr. Murray if he had a rebuttal. Kevin Murray clarified that in his research the City has scheduled the alley improvement for next summer. Mr. Murray expressed that they strongly considered doing an alley access opposed to a flag lot access, but over his years of experience selling property they decided to go for the variance. Mr. Murray respectively asked that the Commission consider the request for the flag lot, and explained in the end, the variance they are requesting asks for a 4 feet difference from 80.25' to 85'. Member John Lott explained that the proposal does meet the Commission's requirements of 1/3 acre lots. Chairman Melanie Shirling asked if there were any other questions. The public hearing was closed for Commission discussion. Member Dee Johnson was under the impression the Hansen property that has been referenced was a flag lot. Member Roy Hobbs explained that it was a flag lot, and a variance wasn't required for his property. Member Lindsay stated they are asking for a 4 foot variance, and if it is going to bring more value to the property owners and the City he supported it. Member Lindsay made a motion to recommend to Council to approve the variance for the Lot 3- B being 80.25. Member Roy Hobbs seconded the motion. All in favor, none opposed. Chris Hart — 4366 Rushton Circle — Concerns regarding land development behind her property. 2 Chairman Melanie Shirling asked if Chris Hart or someone representing her was present. It was verified that she was not present. Commission asked Clerk Roberts if she had any information to share on this item. Clerk Roberts explained that Mrs. Hart had called in last week requesting to be put on the upcoming agenda to share her concerns, but that was all the information she had at this time. Member Dee Johnson explained that he received confirmation that the property had been sold to Rockwell Development, and it involved approximately 80 acres of land, and falls in our Impact Area. Commission opened up the meeting for public comment as there were other citizens present who shared similar concerns. Vee Gibson located at 4062 N. Olsen explained that she is concerned that if the property consists of 80 acres of land at 1/3 acre lots that means approximately 230 homes. She has heard that Rockwell Development wants to put 400 homes in there. Mrs. Gibson is concerned that she and her neighbors will become the entrance to that subdivision, and that traffic will increase. Mrs. Gibson shared that her other concern is that they are going to be starter homes, and the value of her home will be affected. Lamar Stucki located at 4245 Rushton Circle explained he has similar concerns. He inquired if the City can stop the County from making that an entrance at least? He would like to see 1/3 acre lots and is also concerned about the starter home devaluing their property. He would like the City to hopefully be able to make suggestions to the County towards the development. Member Roy Hobbs inquired if that area was a Home Owner's Association. Mr. Stucki said they did not, but did have certain covenants and restrictions. Member Dee Johnson explained that a lot of this at this point is speculation, but if it was to go any further they are many implications of annexation, the impact on city utilities, etc. and explained there is a lot to look at. Member Dee Johnson explained that the normal procedure is that Rockwell should approach the City to request annexation once the property is purchased. He explained there really is nothing we can do at this point until things progress. He suggested talking with Rockwell to verify the information. Area of Impact Agreement Update: Chairman Melanie Shirling explained that the County is still being very non -committal with the letter they sent regarding the request to follow the same rules as the City for 1/3 acre lots. Member Hobbs explained if there was a deadline given, and the county does not agree to it by a certain amount of time, then it potentially can go to court. Member Roy Hobbs inquired if the Commission ever arranged to get on the County's Planning and Zoning agenda. Chairman Melanie Shirling will contact the County to request the City's Planning and Zoning Commission be on the agenda. 3 Reports No reports were given. Our findings and conclusions are centered on four issues: size of Lot 3-B, Lot 3-A as a flag lot and water and sewer service lines from Iona Road, distance to the nearest hydrant, and City related plat clauses. Each issue is addressed respectively. This property is located in the R-1 zone. It is apparent that under § 11-4-6-(A) of the Iona Code, that the minimum frontage allowed in this zone is 85 feet. Lot 3-B would only have 80.25 feet if the City accepted the preliminary plat. For acceptance of this requirement, Mr. Hart would have to apply for a variance under Chapter 14, Title 11 of the City Code. As determined in our June 24, 2015 letter regarding the Hansen re -plat on the other side of the alley and a little east of the subject property, flag lots are permitted provided a permit is obtained under §11-11-26 of the Iona Code. This code section states that lots in a residential zone may be accessed through a private drive which includes asphalt pavement 20 feet wide and an address sign. A review of the site by the Public Works Director revealed that the 20 foot wide flag lot access would be sufficient in this case. As an alternative solution to the above two paragraphs, the developer could eliminate the flag lot access to Iona Road for Lot 3-A and make the flag lot portion of Lot 3-A part of Lot 3-B and then give Lot 3-A a 20 foot wide utility easement through the same area for water and sewer services for Lot 3-A. This would allow Lot 3-B to have more than 85 feet of frontage, thus eliminating the need for a variance and require Lot 3-A to take its access in the alley, which is okay. As indicated in our June 24, 2015 letter regarding the proposed Hansen Replat nearby, the location of nearest fire hydrants to alley accessible homes or homes in flag lots should be considered as part of the approval process. If a variance is secured and the City accepts the preliminary plat as prepared with the flag lot, then a fire hydrant would be useful mid -block along Iona Road between Dayton St. and Main St. If the alternative plan we suggested in the Share Roberts August 26, 2015 Page 2 paragraph above is proposed, then a fire hydrant mid -block at the alley on Main St. or Dayton St. would be the better altemative. As stated in the June 24, 2015 letter regarding the Hansen replat, Section 11-11-26(B)(5) specifically requires flag lots to comply with all fire codes and public safety codes, as a condition for issuance of the permit. It stands to reason that alley accessible lots should also be allowed while ensuring the distance to the nearest hydrant is compatible with current fire and public safety codes. The City needs to determine as a matter of public policy whether it will assume the cost of installing mid -block hydrants or require the applicant to bear such cost as a condition for permit issuance. We have reviewed the plat clauses applicable to the City given on the preliminary plat. Please have the developer use the attached clauses on the final plat. These include City's Acceptance, Irrigation Disclosure and Owners Dedication. This concludes our findings and recommendations. Please contact me if the City has any further questions.
