AN ORDINANCE, appropriating Eight Hundred Sixty-five
Thousand Dollars ($865,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Gravois Creek to be used for
project costs for the construction of sanitary sewers in GC-1
Sanitary Relief Sewer (85122), in the City of Kirkwood, Missouri;
and confirming a contract with J.H. Berra Construction Company,
Inc. for the construction of the aforesaid sanitary sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Seven Hundred Thirteen Thousand Two Hundred and 81/100
Dollars ($713,200.81), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs,
allowance for construction change orders and other costs is One
Hundred Fifty-one Thousand Seven Hundred Ninety-nine and 19/100
Dollars ($151,799.19), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Eight Hundred Sixty-five
Thousand Dollars ($865,000.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Gravois Creek to be used for project costs for the construction of
sanitary sewers in GC-1 Sanitary Relief Sewer (85122), in the City

of Kirkwood, Missouri.
Section Two. The contract heretofore let by the
Executive Director to J.H. Berra Construction Company, Inc. as the
lowest responsible bidder for the construction of sanitary sewers
in GC-1 Sanitary Relief Sewer (85122), in the City of Kirkwood,
Missouri, with the Metropolitan St. Louis Sewer District, pursuant
to bids received and opened on the 20th day of April, 1992 and
formally executed on the 28th day of April, 1992 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
