AN ORDINANCE, appropriating Forty Thousand Five Hundred
Dollars ($40,500.00) from the Operation, Maintenance and
Construction Improvement Fund of Gravois Creek to be used for
project costs for the construction of storm sewers in Clay/Rose
Hill Outfall Storm Sewer (91041), in the City of Kirkwood,
Missouri; and confirming a contract with Bommarito Construction
Company for the construction of the aforesaid storm sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Twenty-seven Thousand Five Hundred Eighty-two Dollars
($27,582.00), and the cost of engineering, inspection,
construction staking, advertisement costs, and allowance for
construction change orders is Twelve Thousand Nine Hundred
Eighteen Dollars ($12,918.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Forty Thousand Five Hundred
Dollars ($40,500.00) is hereby appropriated from the Operation,
Maintenance and Construction Improvement Fund of Gravois Creek to
be used for project costs for the construction of storm sewers in
Clay/Rose Hill Outfall Storm Sewer (91041), in the City of
Kirkwood, Missouri.

Section Two. The contract heretofore let by the
Executive Director to Bommarito Construction Company as the lowest
responsible bidder for the construction of storm sewers in
Clay/Rose Hill Outfall Storm Sewer (91041), in the City of
Kirkwood, Missouri, with the Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 4th day of
May, 1992 and formally executed on the 9th day of June, 1992 by
said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
