AN ORDINANCE, appropriating Sixty-one Thousand One
Hundred Fifty-five Dollars ($61,155.00) from the Operation,
Maintenance and Construction Improvement Fund of Mississippi River
to be used for project costs for the construction of storm sewers
in Keim Homesites (89087), in St. Louis County, Missouri; and
confirming a contract with J.H. Berra Construction Company, Inc.
for the construction of the aforesaid storm sewers, in compliance
with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Forty-one Thousand Five Hundred Thirty-nine and 60/100
Dollars ($41,539.60), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Nineteen Thousand Six
Hundred Fifteen and 40/100 Dollars ($19,615.40), and
WHEREAS, the State of Missouri has agreed to contribute
Twenty Thousand Three Hundred Eighty-five Dollars ($20,385.00)
toward the total costs of said project; upon the receipt of such
funds from said source, said money will be returned to the
Operation, Maintenance and Construction Improvement Fund of
Mississippi River, and
WHEREAS, St. Louis County, Missouri has agreed to
contribute Twenty Thousand Three Hundred Eighty-five Dollars
($20,385.00) toward the total costs of said project; upon the
receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction

Improvement Fund of Mississippi River, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Sixty-one Thousand One Hundred
Fifty-five Dollars ($61,155.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Mississippi River to be used for project costs for the
construction of storm sewers in Keim Homesites (89087), in St.
Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to J.H. Berra Construction Company, Inc. as the
lowest responsible bidder for the construction of storm sewers in
Keim Homesites (89087), in St. Louis County, Missouri, with the
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 14th day of May, 1992 and formally executed on
the 9th day of June, 1992 by said contractor and by the Executive
Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of
the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
