HomeMy Public PortalAbout08696 O R D I N A N C E NO. 8696 AN ORDINANCE, appropriating One Hundred Forty-seven Thousand Four Hundred Dollars ($147,400.00) from the Operation, Maintenance and Construction Improvement Fund of Maline Creek to be used for project costs for the construction of storm sewers in Kathlyn Drive 8800 Block (90130), in the City of Berkeley, Missouri; and confirming a contract with Fred M. Luth & Sons, Inc. for the construction of the aforesaid storm sewers, in compliance with Section 9.040 of the Plan of the District. WHEREAS, the bid for the construction of said storm sewers is One Hundred Seven Thousand Eight Hundred Eight and 05/100 Dollars ($107,808.05), and the cost of engineering, inspection, construction staking, advertisement costs, easement costs, and allowance for construction change orders is Thirty-nine Thousand Five Hundred Ninety-one and 95/100 Dollars ($39,591.95), and WHEREAS, the State of Missouri has agreed to contribute Eight Thousand Two Hundred Four and 94/100 Dollars ($8,204.94) toward the total costs of said project; upon the receipt of such funds from said source, said money will be returned to the Operation, Maintenance and Construction Improvement Fund of Maline Creek, and WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES 2 OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of One Hundred Forty-seven Thousand Four Hundred Dollars ($147,400.00) is hereby appropriated from the Operation, Maintenance and Construction Improvement Fund of Maline Creek to be used for project costs for the construction of storm sewers in Kathlyn Drive 8800 Block (90130), in the City of Berkeley, Missouri. Section Two. The contract heretofore let by the Executive Director to Fred M. Luth & Sons, Inc. as the lowest responsible bidder for the construction of storm sewers in Kathlyn Drive 8800 Block (90130), in the City of Berkeley, Missouri, with the Metropolitan St. Louis Sewer District, pursuant to bids received and opened on the 15th day of May, 1992 and formally executed on the 9th day of June, 1992 by said contractor and by the Executive Director and Secretary-Treasurer on behalf of the District is hereby confirmed, in compliance with Section 9.040 of the Plan of the District. Section Three. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. 3 The foregoing Ordinance was adopted June 10, 1992.
