AN ORDINANCE, appropriating a total of Two Hundred
Ninety-eight Thousand Five Hundred Dollars ($298,500.00) to be
funded as follows: One Hundred Ninety-five Thousand Five Hundred
Dollars ($195,500.00) from the Operation, Maintenance and
Construction Improvement Fund of Coldwater Creek and One Hundred
Three Thousand Dollars ($103,000.00) from the Operation,
Maintenance and Construction Improvement Fund of Upper Paddock
Creek, to be used for the construction of a gabion wall and
appurtenances in Amblewood 3600 Block Channel Improvements
(86039), in the City of Florissant, Missouri; and confirming a
contract with Bates Utility Company, Inc. for the aforesaid
construction, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the aforesaid project is Two
Hundred Fifty-six Thousand Nineteen Dollars ($256,019.00), and the
cost of engineering, inspection, construction staking,
advertisement costs, easement costs, and allowance for
construction change orders is Forty-two Thousand Four Hundred
Eighty-one Dollars ($42,481.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named funds
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Ninety-eight

Thousand Five Hundred Dollars ($298,500.00) to be funded as
follows: One Hundred Ninety-five Thousand Five Hundred Dollars
($195,500.00) from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek and One Hundred Three Thousand
Dollars ($103,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Upper Paddock Creek, is hereby
appropriated to be used for the construction of a gabion wall and
appurtenances in Amblewood 3600 Block Channel Improvements
(86039), in the City of Florissant, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the construction of a gabion wall and
appurtenances in Amblewood 3600 Block Channel Improvements
(86039), in the City of Florissant, Missouri, within the
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 25th day of June, 1992 and formally executed on
the 7th day of July, 1992 by said contractor and by the Executive
Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of
the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
