HomeMy Public PortalAbout08725 O R D I N A N C E NO. 8725 AN ORDINANCE, vacating portions of a sewer easement in Lot 5 of Olivette Executive Office Park, City of Olivette, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has requested this District to vacate the portions of the subject easement, and this District has no further use for said portions, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of a sewer easement are hereby vacated, to wit: Four parcels of land located in Lot 5 of Olivette Executive Office Park as recorded in Plat Book 215, Page 75 of the St. Louis County records. The four parcels being a part of a seven and one-half (7.5) foot wide easement. Parcel 1 Commencing at the most westerly corner of said Lot 5, a point in the Northeast line of Olivette Executive Parkway; thence North 42o 14' 05" East, along the Northwest line of said Lot 5, 5.00 feet to its intersection with the Northeast line of a 5 foot wide easement to St. Louis County Water Co. as established by said subdivision plat, this being the Point of Beginning of the tract described herein; thence continuing North 42o 14' 05" East, along the Northwest line of said Lot 5, 3.42 feet to its intersection with the Southwest line of a 10 foot wide easement as established by said subdivision plat; thence South 22o 46' 21" East, along the Southwest line of said 10 foot wide easement, 8.27 feet to its intersection with the Southeast line of said 7.5 foot wide easement; thence South 42o 14' 05" West, along the Southeast line of said 7.5 foot wide easement, 0.21 feet to its intersection with the Northeast line of said Water Company easement; thence northwesterly, along the Northeast line of said Water Company easement 2 and around a curve to the left that has a radius of 100.00 feet (radial bearing at this point being South 46o 32' 22" West) for an arc length of 7.51 feet to the Point of Beginning. Parcel 2 Commencing at the most westerly corner of said Lot 5, a point in the Northeast line of Olivette Executive Parkway; thence North 42o 14' 05" East, along the Northwest line of said Lot 5, 19.45 feet to its intersection with the Northeast line of a 10 foot wide easement as established by said subdivision plat, this being the Point of Beginning of the tract described herein: thence North 42o 14' 05" East, continuing along the Northwest line of said Lot 5, 36.08 feet to its intersection with the southerly line of another 10 foot wide easement as established by said subdivision; thence North 77o 17' 39" East, along the southerly line of the last mentioned 10 foot wide easement, 13.06 feet to its intersection with the Southeast line of said 7.5 foot wide easement; thence South 42o 14' 05" West, along the Southeast line of said 7.5 foot wide easement, 50.26 feet to its intersection with the Northeast line of the first mentioned 10 foot wide easement; thence North 22o 46' 21" West, along the Northeast line of the last mentioned 10 foot wide easement, 8.27 feet to the Point of Beginning. Parcel 3 Commencing at the most westerly corner of said Lot 5, a point in the Northeast line of Olivette Executive Parkway; thence North 42o 14' 05" East, along the Northwest line of said Lot 5, 72.94 feet to its intersection with the northerly line of a 10 foot wide easement as established by said subdivision plat, this being the Point of Beginning of the tract described herein: thence northeasterly and easterly along the northwesterly and northerly lines of said Lot 5, as follows: 1st, North 42o 14' 05" East, 24.39 feet to a point; 2nd, South 89o 29' 23" East, 61.28 feet to its intersection with the northerly line of said 10 foot wide easement; thence South 77o 17' 39" West, along the northerly line of said 10 foot wide easement, 32.80 feet to its intersection with the southerly line of said 7.5 foot wide easement; thence westerly and southwesterly, along the southerly and southeasterly lines of said 7.5 foot wide easement, as follows: 1st, 3 North 89o 29' 23" West, 25.98 feet to a point; 2nd, South 42o 14' 05" West, 10.34 feet to its intersection with the northerly line of said 10 foot wide easement; thence South 77o 17' 39" West, along the northerly line of said 10 foot wide easement, 13.06 feet to the Point of Beginning. Parcel 4 Commencing at the Northeast corner of said Lot 5; thence North 89o 29' 23" West, along the northerly line of said Lot 5, 10.0 feet to its intersection with the westerly line of a 10 foot wide easement as established by said subdivision plat; thence South 00o 30' 37" West, along the westerly line of said 10 foot wide easement, 1.18 feet to its intersection with the southerly line of another 10 foot wide easement as established by said subdivision plat, this being the Point of Beginning of the tract described herein: thence South 00o 30' 37" West, and continuing along the westerly line of the first mentioned 10 foot wide easement, 6.32 feet to its intersection with the southerly line of said 7.5 foot wide easement; thence North 89o 29' 23" West, along the southerly line of said 7.5 foot wide easement, 26.92 feet to its intersection with the second mentioned 10 foot wide easement; thence North 77o 17' 39" East, along the northerly line of the second mentioned 10 foot wide easement, 27.65 feet to the Point of Beginning. 4 The foregoing Ordinance was adopted July 8, 1992. 5 Mid-America Transplant Association
