AN ORDINANCE, appropriating Four Hundred Fifty-four
Thousand Five Hundred Dollars ($454,500.00) from the Operation,
Maintenance and Construction Improvement Fund of Gravois Creek to
be used for project costs for the construction of storm sewers in
Kirkwood Road-Commerce-Reardon Phase I (85227)), in the City of
Kirkwood, Missouri; and confirming a contract with R.V. Wagner,
Inc. for the construction of the aforesaid storm sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Four Hundred Four Thousand Eight Hundred Ninety-nine
Dollars ($404,899.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Forty-nine Thousand
Six Hundred One Dollars ($49,601.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Four Hundred Fifty-four
Thousand Five Hundred Dollars ($454,500.00) is hereby appropriated
from the Operation, Maintenance and Construction Improvement Fund
of Gravois Creek to be used for project costs for the construction
of storm sewers in Kirkwood Road-Commerce-Reardon Phase I (85227),
in the City of Kirkwood, Missouri.

Section Two. The contract heretofore let by the
Executive Director to R.V. Wagner, Inc. as the lowest responsible
bidder for the construction of storm sewers in Kirkwood Road-
Commerce-Reardon Phase I (85227), in the City of Kirkwood,
Missouri, with the Metropolitan St. Louis Sewer District, pursuant
to bids received and opened on the 16th day of July, 1992 and
formally executed on the 11th day of August, 1992 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted August 12, 1992.
