HomeMy Public PortalAbout08754 O R D I N A N C E NO. 8754 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict, and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict, and that the interests of sanitation and public health of the District and the Subdistrict will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of 2 the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District and the Fee Fee Trunk Sewer Subdistrict, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. 3 EXHIBIT A A tract of land in the Northeast Quarter of Section 35, Township 45 North, Range 3 East, St. Louis County, Missouri; being all of a tract of land described in deed to Goddard-Fuchs Realty Company by Deed Book 6820, Page 1772, and all of a tract of land described in deed to Rudolph and Jane Swistowicz by Deed Book 3647, Page 72, and part of Old Eatherton Road and part of New Eatherton Road (Missouri State Highway No. 109), and being more particularly described as: Commencing at a point in the existing Western boundary of the Fee Fee Trunk Sewer Subdistrict of the Metropolitan St. Louis Sewer District as described in Ordinance No. 3267, which point is the intersection of the centerline of New Eatherton Road, 60 feet wide, (Missouri State Highway No. 109) with the East and West center section line of Section 35, Township 45 North, Range 3 East, and which point is shown as being Station 84+73.70 on the centerline of New Eatherton Road on the "EATHERTON ROAD PLAT OF DEDICATION" recorded in Plat Book 28, Page 67; thence Westerly along said East and West center section line of Section 35 to a point being the Southeast corner of the aforesaid Goddard-Fuchs Realty Company tract, and the actual point of beginning of the herein described tract; thence Westerly along said East and West center section line to the center of Section 35; thence Northerly along the North and South center section line of Section 35 to the Northwest corner of the aforesaid Swistowicz tract; thence Easterly along the North line of said Swistowicz tract to a point in the West line of Old Eatherton Road, 40 feet wide; thence Northerly along said West line of Old Eatherton Road to a point in the centerline of New Eatherton Road, 60 feet wide, (Missouri State Highway No. 109), which centerline is also the aforesaid Western boundary of the Metropolitan St. Louis Sewer District; thence Southeasterly along said centerline of New Eatherton Road and along said Western boundary of the Metropolitan St. Louis Sewer District to a point in the Northerly prolongation of the East line of Old Eatherton Road, 40 feet wide; thence Southerly along said East line of Old Eatherton Road and its prolongation to a point in the Easterly prolongation of the North line of a tract described in deed to Arthur J. Zimmerly, etal. by Deed Book 8797, Page 793, which line is a common line between said Zimmerly tract and the aforesaid Goddard-Fuchs Realty Company tract; thence Westerly along said common line and its Easterly prolongation to the Northwest corner of said Zimmerly tract; thence Southerly along a common line between said Zimmerly tract and said Goddard-Fuchs Realty Company tract to the actual point of beginning. 4 The foregoing Ordinance was adopted September 9, 1992.
