Assistant. 1. Gerald Bojanowski-81 Pine Ridge Road-discuss letter received 7/26/11 Mr. Bojanowski is questioning the Health Director's decision that he needs to upgrade his septic system because of him having a block pit. He was told by inspectors that it would fail in Brewster. NI handed out her review of this issue. She spoke about the past two inspection reports from 1999 and 2002. Both reports state that it is a leaching pit. She did not look at the file at the time those inspections came in. She stated that according to the Brewster Real Estate Transfer Regulation 5.5, if she (as the Health Director) deems it as a marginal system, she has the right to tell the homeowner that it needs to be replaced or repaired. The system is from 1973. The Board stated that they are not inclined to overrule the Health Director's decision and that he would have to upgrade the system at the time of a sale. MC suggested to NI that she find something in writing that explains the difference between block pits & pre cast pits. 2. Discuss 98 Ebenezer Lane MC asked for an update and asked how long this condition had prevailed. NI explained the situation and stated that this had been going on since 2006. NI spoke about foreclosure and condemning the house. She also told the Board that this has gone to Town Counsel for a review. The Board decided that they would hold off for two weeks and if there is no resolution to this problem, they will begin the procedure to condemn the property. They asked that Mrs. Delano be invited to a meeting to let her know that that Board has the intention to condemn her property. 3. Discuss Health Director's new objectives The Board had some suggestions. Daniels will stay on as an objective because it is on going. MC suggested that a broader objective is needed for forms, regulations, policies, educational material for the website. She thought that we should make sure that the forms are up to date and easily accessible on the website. NI will write out the objectives and bring them back to the Board for approval at the next meeting. 4. Discuss having George Heufelder come to Board to talk about variance request, etc. The Board thought that this would be a good idea and asked that NI invite him into a meeting. 5. KJ seconded. 5 yes. 7. Discuss Planning Board application for Brewster Solar Garden Noted. 8. Richard Judd-variance request for 129 Canoe Pond Drive (This was brought up under"items the chair didn't reasonable anticipate") The variance request is for the leaching facility to be 217 feet from the pond. MC spoke about criteria for variances and that the Board should be asking for something in return for granting the variance. Motion: KJ-approve variance request. LS seconded. 5 yes.
