AN ORDINANCE, appropriating a total sum of Two Hundred
Ninety-six Thousand Dollars ($296,000.00) to be funded as follows:
Three Thousand Seven Hundred Forty-four Dollars ($3,744.00) from
the Sugar Creek Operating Fund, Sixty Thousand Seventeen Dollars
($60,017.00) from the Subdistrict Planning Fund, and Two Hundred
Thirty-two Thousand Two Hundred Thirty-nine Dollars ($232,239.00)
from the General Fund of the District, to be used for project
costs for Site Closures at the Old North Maintenance Yard and
Sugar Creek Sites (93002), in St. Louis County, Missouri;
confirming a contract with Brooks Grading & Excavation for the
aforesaid site closures, in compliance with Section 9.040 of the
Plan of the District; and authorizing the Executive Director and
Secretary-Treasurer on behalf of the District to enter into a
contract with O'Brien & Gere Engineers, Inc. for Step III
construction management services for the aforesaid site closures.
WHEREAS, the bid for said site closures is Two Hundred
Fifty Thousand Nine Hundred Thirty-five Dollars ($250,935.00), and
the cost of engineering, inspection, advertisement costs, and
allowance for construction change orders is Forty-five Thousand
Sixty-five Dollars ($45,065.00), and
WHEREAS, the Director of Finance has certified that
there are unencumbered balances in the above-named funds
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of Two Hundred Ninety-six
Thousand Dollars ($296,000.00) to be funded as follows: Three

Thousand Seven Hundred Forty-four Dollars ($3,744.00) from the
Sugar Creek Operating Fund, Sixty Thousand Seventeen Dollars
($60,017.00) from the Subdistrict Planning Fund, and Two Hundred
Thirty-two Thousand Two Hundred Thirty-nine Dollars ($232,239.00)
from the General Fund of the District is hereby appropriated to be
used for project costs for the Site Closures at the Old North
Maintenance Yard and Sugar Creek Sites (93002), St. Louis County,
Missouri.
Section Two. The contract heretofore let by the
Executive Director to Brooks Grading & Excavation as the lowest
responsible bidder for the Site Closures at the Old North
Maintenance Yard and Sugar Creek Sites (93002), in St. Louis
County, Missouri, with the Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 24th day of August,
1992 and formally executed on the 8th day of September, 1992 by
said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. The Executive Director and Secretary-
Treasurer are hereby authorized to enter into a contract with
O'Brien & Gere Engineers, Inc. for Step III construction
management services for the Site Closures at the Old North
Maintenance Yard and Sugar Creek Sites (93002), in St. Louis
County, Missouri, said contract to be comprised of such terms and
conditions as are approved by the office of the General Counsel of
the District.
Section Four. This ordinance, being an appropriation

ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted September 9, 1992.
