HomeMy Public PortalAbout08780 O R D I N A N C E NO. 8780 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer on behalf of the Metropolitan St. Louis Sewer District to sell and convey to the County of St. Louis, certain real property of the District (known as Parcel #117, the Carman Road Property) located in St. Louis County, Missouri, and prescribing the terms of said transaction. WHEREAS, the real property hereinafter described has been declared as surplus pursuant to Resolution No. 1998, and WHEREAS, pursuant to Resolution No. 2016, adopted the 18th day of September, 1991, said real property will be sold to St. Louis County, Missouri. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer on behalf of the Metropolitan St. Louis Sewer District are hereby authorized and directed to sell and convey to the County of St. Louis, certain real property of the District located in St. Louis County, Missouri for the total sale price of Seventy- one Thousand Dollars ($71,000.00), said real property being described as follows: Two (2) parts of a tract of land being part of Lot 11 of the subdivision by the Commissioners and partition of the Peter Breen estate, being Cause No. 91 of the October term 1860 of the St. Louis Land Court styled James H. Russell et al vs. Betsy Ann Breen et al, according to the plat thereof attached to said Commissioners' report recorded in Book 376, page 346, of the St. Louis City (formerly County) Recorder's Office, said tract of land being located in Sections 8 and 9, Township 44 North, Range 5 East, and being more particularly described as follows: 2 RIGHT-OF-WAY Part One Beginning at a point on the east line of Dougherty Ferry Road (40 feet wide), said point being the northwest corner of property conveyed to Metropolitan St. Louis Sewer District by instrument recorded in Deed Book 7903, Page 1003, of the St. Louis County Records; thence South 58 degrees 04 minutes 07 seconds East and along the north line of said Metropolitan St. Louis Sewer District property a distance of 69.68 feet to a point; thence South 26 degrees 50 minutes 58 seconds West a distance of 341.34 feet to a point on the south line of said Metropolitan St. Louis Sewer District property; thence North 58 degrees 04 minutes 07 seconds West along said south line a distance of 79.92 feet to a point on the east line of Dougherty Ferry Road, as aforesaid; thence North 27 degrees 25 minutes 53 seconds East along said east line a distance of 253.03 (254.28 deed) feet to a point; thence North 31 degrees 50 minutes 32 seconds East a distance of 87.75 (86.52 deed) feet to the point of beginning and containing 26,286 square feet, more or less. PARTY OF THE FIRST PART HEREBY RESERVES UNTO ITSELF, its successors and assigns, the right to construct, reconstruct, maintain, and improve a sewer or sewers on the following described property: Two (2) strips of land, each 20 feet wide, and centered about lines described as follows: Line A Beginning at a point on the southwestern line of the aforementioned Sewer District property, said point being 30.00 feet southeast of the most western corner of said Sewer District property; thence northeastwardly along a line 30.00 feet southeast of and parallel with the southeastern right-of-way line of Dougherty Ferry Road (40 feet wide), North 27 degrees 25 minutes 53 seconds East a distance of 260.69 feet to an angle point; thence continuing along a line being 30.00 feet southeast of and parallel with the southeast right-of-way line of Dougherty Ferry Road (40 feet wide), North 31 degrees 50 minutes 32 seconds East a distance of 80.13 feet to the point of ending, said point being on the northeast line of said Sewer District property. Line B Beginning at a point on the northwestern line of the aforementioned Sewer District property, being distant South 31 degrees 50 minutes 32 seconds West, 86.52 feet southwest of the most northern corner of said Sewer District property; said point of beginning also being on the southeastern right-of-way line of Dougherty 3 Ferry Road (40 feet wide); thence southeastwardly, South 70 degrees 13 minutes 15 seconds East a distance of 30.35 feet to the point of ending, being the angle point as indicated in the above mentioned Line A description. REAL ESTATE Part Two Commencing at the intersection of the southern line of said Lot 11 with the eastern line of Dougherty Ferry Road (40 feet wide), said intersection being the southwestern corner of property conveyed to Rowland Investment Company by deed recorded in Book 6323, Page 368, of the St. Louis County Recorder's Office; thence along said eastern line of Dougherty Ferry Road North 27 degrees 25 minutes 53 seconds East a distance of 887.02 feet to the point of beginning of the tract of land to be described; thence continuing along said eastern line of Dougherty Ferry Road the following courses and distances, North 27 degrees 25 minutes 53 seconds East a distance of 254.28 feet; thence North 31 degrees 50 minutes 32 seconds East a distance of 86.52 feet; thence leaving said eastern line of Dougherty Ferry Road South 58 degrees 04 minutes 07 seconds East a distance of 305.00 feet; thence South 13 degrees 04 minutes 07 seconds East a distance of 120.21 feet; thence South 31 degrees 55 minutes 53 seconds West a distance of 255.00 feet; thence North 58 degrees 04 minutes 07 seconds West a distance of 368.33 feet to the point of beginning, exepting therefrom that part described above as Right-of-Way. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed on behalf of the Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above, and further to deposit the proceeds from said sale and conveyance in the reserve for Real Property Purchase, Improvement and Alterations Account. 4 The foregoing Ordinance was adopted October 14, 1992.
