Board of Health Meeting
Tuesday, September 6, 2011 at 7:00PM
Town Hall, Room A
Present: Joanne Hughes, Chairman, Lem Skidmore, Vice Chairman, Keith Johnson, Mary Chaffee, Nancy Ellis
Ice, Health Director and Tammi Mason, Senior Department Assistant.
1. Eagle Surveying-variance request for 287 Slough Road (less than 300'to pond)
Steve Haas was present. The system is being upgraded from cesspools to a Title V. The SAS will be 160'
from Slough Pond and 300'from Pine Pond. It is 81/2 feet from groundwater.
Motion: KJ-approve variance request with Environmentally Sensitive Area conditions applying. MC
seconded. 4 yes.
2. Cape Cod Engineering-seeking approval for I/A system at Lot 5 Carson's Path
Bob Perry stated that these lots were required to have I/A systems by the Planning Board. This will
be a Micro Fast 0.9 system. 0 & M agreement has been done but not handed in yet.
Motion: LS-approve I/A system. KJ seconded. 4 yes.
3. Robert &Judith Busam-41 Misty Lane-appeal of Health Director's decision to order a septic
Inspection for an addition
Mr. & Mrs. Busam would like to finish 90SF of space for an office and they would like to not have to
do a septic inspection. The septic system is less than 10 years of age and is appropriately sized for
this addition.
Motion: MC-approve the request to not have a septic inspection because the system is less
than 10 years of age and well maintained. KJ seconded. 4 yes.
4. 98 Ebenezer Lane-failure to upgrade septic system
Diana Delano and Sheila Cooper, owner and occupant were present. The Board asked if they had
made any progress with getting the septic system upgraded. Ms. Delano stated that she has spoken
with an agency with regards to getting the taxes owed paid off. She stated that she had not been
able to put any money towards the taxes and still can't qualify for a loan. NI stated that the system
is a converted cesspool system, which technically is still allowed, although this one is in failure and
has been since July 23, 2009.

MC suggested looking into selling the property and consulting a real estate lawyer to help them out
with the problems. There was discussion on how long they would have before they would be
required to leave the property if it was condemned.
The Board agreed that they need more information from Town Counsel and the Town Administrator
before they can make a decision. They agreed to postpone any decision until October 4, 2011 at
their next regularly scheduled meeting. They would like to bring this up again in 2 weeks to hear any
updates from Town Counsel and Town Administrator.
5. Discuss Planning Board application for Ocean Edge
NI stated that a septic inspection had been done already.
This was noted by the Board

There was a minor change.
Motion: KJ-approve minutes. LS seconded. 4 yes.
7. Minutes from 8/16/11
Motion: LS-approve minutes. MC seconded. 4 yes.
Bills to be paid were signed by the Chairman
The Board brought up the dogs on the beach issue and decided that a discussion was needed on the
regulation and signs.
The Board will discuss dogs at Drummer Boy Park at the next work meeting.
MC gave an update on the Recycling Committee.
