HomeMy Public PortalAbout08794 O R D I N A N C E NO. 8794 AN ORDINANCE, appropriating Ninety-eight Thousand Dollars ($98,000.00) from the Improvement Fund to be used for project costs for the construction of sanitary sewers in Subdistrict No. 91021 (Old Baumgartner & Heintz) in St. Louis County, Missouri; and confirming a contract with Karsten Equipment Company for the aforesaid construction, in compliance with Section 9.040 of the Plan of the District. WHEREAS, the bid for the construction of said sanitary sewers is Seventy-nine Thousand Four Hundred Fifty Dollars ($79,450.00), and the costs of engineering, survey, inspection, construction staking, advertisement costs, easement charges, allowance for construction change orders, and processing and administration of tax bills is Eighteen Thousand Five Hundred Fifty Dollars ($18,550.00), and WHEREAS, proceedings have been taken for the construction of sanitary sewers in Subdistrict No. 91021 (Old Baumgartner & Heintz), and Forty-nine Thousand Dollars ($49,000.00) of said construction costs is to be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement. WHEREAS, St. Louis County, Missouri, pursuant to the Housing and Community Development Act of 1974, has agreed to contribute Forty-nine Thousand Dollars ($49,000.00) toward the total costs of said project; upon the receipt of such funds from said source, said money will be returned to the Improvement Fund, and 2 WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of Ninety-eight Thousand Dollars ($98,000.00) is hereby appropriated from the Improvement Fund to be used for project costs for the construction of sanitary sewers in Subdistrict No. 91021 (Old Baumgartner & Heintz), in St. Louis County, Missouri pending payment into the Improvement Fund of the costs hereby appropriated in aid from any source, and from the proceeds of collection of special benefit assessments levied, or special tax bills issued, to pay a portion of such costs. Section Two. The contract heretofore let by the Executive Director to Karsten Equipment Company as the lowest responsible bidder for the construction of sanitary sewers in Subdistrict No. 91021 (Old Baumgartner & Heintz), in St. Louis County, Missouri, with The Metropolitan St. Louis Sewer District, pursuant to bids received and opened on the 21st day of September, 1992 and formally executed on the 13th day of October, 1992 by said contractor and by the Executive Director and Secretary- Treasurer on behalf of the District is hereby confirmed, in compliance with Section 9.040 of the Plan of the District. Section Three. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. The foregoing Ordinance was adopted October 14, 1992.
