AN ORDINANCE, appropriating a total of Nine Hundred
Fifty-eight Thousand Dollars ($958,000.00) to be funded as
follows: Six Hundred Ninety-four Thousand Dollars ($694,000.00)
from the Operation, Maintenance and Construction Improvement Fund
of Maline Creek and Two Hundred Sixty-four Thousand Dollars
($264,000.00) from the Operation, Maintenance and Construction
Improvement Fund of Black Jack-Dellwood Creek, to be used for
project costs for the construction of a paved channel and storm
sewers in Hallstead Storm Channel Phase II (91068), in St. Louis
County, Missouri; and confirming a contract with Gershenson
Construction Company, Inc. for the aforesaid construction, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the aforesaid project is Eight
Hundred Thirty Thousand Five Hundred Forty-one and 95/100
($830,541.95), and the cost of engineering, inspection,
construction staking, advertisement costs, and allowance for
construction change orders is One Hundred Twenty-seven Thousand
Four Hundred Fifty-eight and 05/100 Dollars ($127,458.05), and
WHEREAS, the State of Missouri has agreed to contribute
Seventy-five Thousand Eight Hundred Sixty-seven Dollars
($75,867.00) toward the total costs of said project; upon the
receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction
Improvement Fund of Maline Creek, and
WHEREAS, St. Louis County, Missouri has agreed to

contribute One Hundred Thousand Dollars ($100,000.00) toward the
total costs of said project; upon the receipt of such funds from
said source, said money will be returned to the Operation,
Maintenance and Construction Improvement Fund of Maline Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named funds
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Nine Hundred Fifty-eight
Thousand Dollars ($958,000.00) to be funded as follows: Six
Hundred Ninety-four Thousand Dollars ($694,000.00) from the
Operation, Maintenance and Construction Improvement Fund of Maline
Creek and Two Hundred Sixty-four Thousand Dollars ($264,000.00)
from the Operation, Maintenance and Construction Improvement Fund
of Black Jack-Dellwood Creek, is hereby appropriated to be used
for project costs for the construction of a paved channel and
storm sewers in Hallstead Storm Channel Phase II (91068), in St.
Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Gershenson Construction Company, Inc. as the
lowest responsible bidder for the construction of a paved channel
and storm sewers in Hallstead Storm Channel Phase II (91068), in
St. Louis County, Missouri, within The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 14th

day of September, 1992 and formally executed on the 13th day of
October, 1992 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
