HomeMy Public PortalAbout08813 O R D I N A N C E NO. 8813 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease real property of The Metropolitan St. Louis Sewer District lying in St. Louis County, Missouri to James E. McNeil and Carol McNeil, his wife, for use as an office/residence; and to execute and deliver a Lease Agreement upon terms and conditions hereinafter set out. WHEREAS, the District owns certain real property in St. Louis County, Missouri known and numbered as 5292 Baumgartner Road, and WHEREAS, said property consists of a single family residence and parking area and, WHEREAS, pursuant to Resolution No. 2060 adopted July 8, 1992, the District is willing to enter into such a lease, and believes it to be advantageous and in the public interest to do so. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to lease to James E. McNeil and Carol McNeil, his wife, upon the general terms and conditions hereinafter set forth, the following described real property: A parcel of land being part of U.S. Survey 2968, Township 43 North, Range 6 East, St. Louis County, Missouri being described as follows: commencing at a point in the North line of the Meramec River, said point being the Southwest corner of U.S. Survey 2968 and also the 2 Southeast corner of "Gast's Meramec View Subdivision" as recorded in Plat Book 17, Page 40 of the St. Louis County Records; thence North 23 degrees 22 minutes East along the West line of said U.S. Survey 2968 also being the east line of said "Gast's Meramec View Subdivision" and also being the East line of property conveyed to Arthur Grab by deed recorded in Book 4287, Page 203 of the St. Louis County Records, a distance of 1879.70 feet to a point in the South R.O.W. line of New Baumgartner Road being 60 foot wide, said point being the point of beginning of parcel herein described; thence following along the South R.O.W. of said road in a southeastwardly direction along a curve to the right having a radius of 2834.93 feet a chord bearing South 60 degrees 17 minutes 50 seconds East 240.15 feet an arc distance of 240.22 feet; thence continuing along said R.O.W. South 57 degrees 52 minutes 10 seconds East a distance of 18.00 feet; thence leaving said R.O.W. South 23 degrees 16 minutes 33 seconds West a distance of 112.42 feet; thence South 56 degrees 46 minutes 37 seconds East a distance of 16.00 feet; thence South 33 degrees 13 minutes 23 seconds West a distance of 225.00 feet; thence North 68 degrees 19 minutes 35 seconds West a distance of 234.00 feet to the intersection of the West line of said U.S. Survey 2968; thence along said West line North 23 degrees 22 minutes 00 seconds East a distance of 373.00 feet to the point of beginning. Containing 2.08 acres. Section Two. The lease shall be for one year at the rental of Five Hundred Twenty-five Dollars ($525.00) per month for the term of the lease. The lease shall also allow the option to extend the lease for two (2) additional one year terms. Section Three. The Executive Director and Secretary- Treasurer are hereby authorized to execute and deliver on behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other terms and conditions as approved by the office of the General Counsel of the District. 3 The foregoing Ordinance was adopted November 13, 1992.
