Felco Engineering-variance requests for 1107 Main Street David Lajoie presented this to the Board. The following variances are being requested: 1. 2'from SAS to property line (street) 2. 2'from SAS to property line (Parcel 50) 3. 48'from SAS to wetland (intermittent stream) NI explained to the Board that DL had not done perc testing yet and there was a question about the floor plan and size of the system so she did not review the plan. DL stated that perc tests are being done on October 6th and that they couldn't have been done earlier because the lot is very tight. He stated that Conservation Commission has given approval already. There is no increase in use. He also let the Board know that he would be using H-10 for the septic tank and H-20 for the SAS. JH told DL that they may require pressure dozing or an I/A system to be put in. DL asked that this be continued. Motion: KJ-continue this hearing until November 1, 2011 meeting. MC seconded. 4 yes. 2. Bennett Environmental Associates, Inc.-variance request for 27 Captain Dunbar Road David Bennett presented this to the Board. The following variances are being requested: 1. 5'from SAS to western property line 2. 6'from SAS to southern property line 3. 8'from SAS to cellar wall 4. 3.3'from SAS to water service line 5. 5'from tank to southern property line 6. 7'from septic tank to cellar wall DB explained that is house is a 3 bedroom and they are proposing to keep it at that. The placement of the new septic system is really the only possible place to put it. There is no cellar or foundation, this home is on a pile driven structure. Conservation Commission has not approved this yet. It is on the agenda for tonight. DB stated that it is approximately 25'to groundwater and that the water line is either a 6 or 8 inch existing main. JH spoke about the letter from the abutter. Attorney Duane Landreth was present to represent that abutter. He stated that this proposed septic system is 20'from his client's septic system and that the overdig for this would encroach onto his client's property by about 11 feet. Attorney Landreth stated that he believes that this new system could be put on the south side of the property which the owner has control of. DB gave the Board a copy of an email he had sent to Attorney Landreth with respect to the abutters concerns. He also showed the Board pictures of the property. Attorney Landreth spoke about the neighbor's right to privacy of their lot and that the BOH should consider that in their decision. He spoke about a possible lawsuit if the Board approved this. Motion: MC-continue this hearing for 2 weeks so that discussions can take place between the abutter and the homeowner and so Conservation Commission can approve it. K) seconded. 4 yes. 3. Mark Dunham-appeal of Health Director's decision re: addition at 31 Greenland Pond Road Mr. Dunham is asking that he be allowed to change a garage into a family room without changing his septic system. NI explained that this system is from 1992 and although the plan says 4 bedrooms, the permit states 3. JH asked NI what the bedroom count would be according to Title 5. NI stated that is would be 3. Motion: MC-approve request for addition. JF seconded. 4 yes. 4. Robert & Barbara Ervey-appeal of upgrade order at 61 Consodine Road This was taken off the agenda. The Ervey's are proceeding with the upgrade. 5. Continued hearing on 98 Ebenezer Lane-failure to upgrade septic system Diana Delano and Sheila Cooper were present. Reverend Mary Dancel was also present. Ms. Cooper stated that she did call about 20 engineers and only 2 returned her calls. Those 2 both said that it was a very unusual case and they would think about it and get back to them. She stated that she had not heard back from them yet, but she did find out that it would cost between 15,000 and 20,000 dollars to replace the system. No one is going to give her a loan because of the taxes she owes. MC stated that she had hoped that more progress would have been made by now. JF asked when the first time they came to the Board was. NI went over the time line with the Board. BOH 10/4/11 Minutes Page 3 Motion: MC-continue this for 1 month. If in that month there is no plan in place or contract secured, the Board will vote to condemn the property. KJ seconded. 4 yes. 6. Discuss email from David Bennett re: Captains Course Turf Management plan David Bennett has not had a chance to talk with anyone about this yet. The Board will bring it up again at the next meeting. 7. Discuss letter from Waquoit Bay National Estuarine Research Reserve The clerk will send them Keith Johnsons email. Bills to be paid were signed by the Chairman NI handed out the booklet: Evaluation of Methods to Control Phosphorus in areas served by onsite septic systems and the booklet: Performance of innovative/Alternative onsite septic systems for the removal of nitrogen. NI gave an update on Leanne Trefrey at 77 Stony Brook Road. She has been in the hospital since mid August and will probably be returning home at the end of this week.
