AN ORDINANCE, appropriating Two Million Two Hundred
Thirty-five Thousand Dollars ($2,235,000.00) from the Sanitary
Replacement Fund to be used for project costs for the construction
of a pump station and appurtenances in LC-03 Lemay Creek Sanitary
Relief (89099), in St. Louis County, Missouri; confirming a
contract with Fru-Con Construction Corporation for the
construction of the aforesaid pump station and appurtenances, in
compliance with Section 9.040 of the Plan of the District; and
authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District to enter into
an amendment to Contract E-655 with Lenz Engineering Company for
design revision and construction inspection services during the
construction of the aforesaid pump station and appurtenances.
WHEREAS, the bid for the construction of said pump
station and appurtenances is One Million Nine Hundred Twenty-six
Thousand Dollars ($1,926,000.00), and the cost of engineering,
inspection, construction staking, advertisement costs, license
costs, and allowance for construction change orders is Three
Hundred Nine Thousand Dollars ($309,000.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Two Hundred

Thirty-five Thousand Dollars ($2,235,000.00) is hereby
appropriated from the Sanitary Replacement Fund to be used for
project costs for the construction of a pump station and
appurtenances in LC-03 Lemay Creek Sanitary Relief (89099), in St.
Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Fru-Con Construction Corporation as the
lowest responsible bidder for the construction of a pump station
and appurtenances in LC-03 Lemay Creek Sanitary Relief (89099), in
St. Louis County, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 4th day of
November, 1992 and formally executed on the 17th day of November,
1992 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to enter into an amendment to Contract E-655
with Lenz Engineering Company for design revision and construction
inspection services during the construction of a pump station and
appurtenances in LC-03 Lemay Creek Sanitary Relief (89099), in St.
Louis County, Missouri; said contract to be comprised of such
terms and conditions as are approved by the office of the General
Counsel of the District.
Section Four. This ordinance, being an appropriation

ordinance, shall take effect immediately upon its enactment. The foregoing Ordinance was adopted December 11, 1992.
