HomeMy Public PortalAbout08836 O R D I N A N C E NO. 8836 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to grant to Union Electric Company an easement for the operation and maintenance of electric transmission lines along with service connections and appurtenances thereto over and across certain property of the District known as the Bissell Point Secondary Treatment Plant, in the City of St. Louis, Missouri, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the Union Electric Company has asked the District for the right to construct, operate and maintain said electric transmission lines, over and across certain hereinafter described real property of the District known as the Bissell Point Secondary Treatment Plant, and the District is desirous of granting such right for the good of the general public, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the Union Electric Company an easement for the operation and maintenance of electric transmission lines along with service connections and appurtenances thereto over and across certain real property of the District as hereinafter described in the City of St. Louis, Missouri, such property being described as follows: An irregular shaped parcel of land being part of a tract of land in City Block 3319 of the City of St. Louis, 2 Missouri; as described by Deed thereof recorded in Book M615, Page 213 and Book M482, Page 194 of the City of St. Louis, Missouri, Records. Said irregular shaped parcel of land is further described as beginning at a point in the South line of hereinabove described tract of land in said Book M482, Page 194; said point being one hundred and ninety (190) feet east of the East line of Hall Street (80' wide); thence North and parallel with said Hall Street, a distance of eighteen (18) feet to a point; thence in a westerly direction a distance of one hundred twelve (112) feet more or less to a point; thence South and parallel with said Hall Street a distance of thirty (30) feet to a point in the South line of hereinabove described tract of land in Book M615, Page 213; thence East one hundred and ten (110) feet to the point of beginning. Section Two. The rights herein granted are limited to such rights as the District may have in the premises concerned and the Union Electric Company shall secure such permission as may be necessary on account of any other existing rights. Section Three. Grantor's right to the use of such property for sewer and drainage purposes is hereby reserved. Section Four. Grantee shall at its own sole cost and expense relocate, change or adjust such portion of its electric transmission system as is reasonably necessary in order to avoid interference with construction and operation of Grantor's facilities in aforesaid property. Section Five. The Executive Director and Secretary- Treasurer are hereby authorized to execute in behalf of the District an instrument giving effect to Sections One, Two, Three, and Four. 3 The foregoing Ordinance was adopted December 11, 1992.
