AN ORDINANCE, appropriating Five Hundred Eighty-five
Thousand Dollars ($585,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Black Creek, to be used for
project costs for the construction of a reinforced concrete
vertical wall channel and storm and sanitary sewers in Hampton
Creek Elinor to I-64 Storm Channel (91044), in the City of
Richmond Heights, Missouri; and confirming a contract with Bates
Utility Company, Inc. for the aforesaid construction, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the aforesaid project is Five
Hundred Five Thousand Four Hundred Forty-three Thousand Dollars
($505,443.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Seventy-nine Thousand
Five Hundred Fifty-seven and no/100 ($79,557.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Five Hundred Eighty-five
Thousand Dollars ($585,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Black Creek, is hereby
appropriated to be used for project costs for the construction of
a reinforced concrete vertical wall channel and storm and sanitary
sewers in Hampton Creek Elinor to I-64 Storm Channel (91044), in
the City of Richmond Heights, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the construction of a reinforced concrete
vertical wall channel and storm and sanitary sewers in Hampton
Creek Elinor to I-64 Storm Channel (91044), in the City of
Richmond Heights, Missouri, within The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 13th
day of November, 1992 and formally executed on the 8th day of
December, 1992 by said contractor and by the Executive Director
and Secretary-Treasurer on behalf of the District is hereby
confirmed, in compliance with Section 9.040 of the Plan of the
District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted January 19, 1993.
