Bennett Environmental Associates, Inc.-Variance requests for Captain Dunbar Road This is a continued hearing. David Bennett submitted new plans to the Board, which moved the system further away from the abutter's property line. The following variances were applied for: 1. To allow the SAS to be 1 foot from a property line 2. To allow the SAS to be 10.8 feet from a cellar wall and 6.4 feet from a cellar wall Conservation has already approved the project. Motion: MC-approve variance requests with the finding that the Board views the proposed mitigations as giving more protection to the public health. KJ seconded. 5 yes. Environmentally Sensitive Area conditions apply. 2. David Bennett-discuss Risk Management Incorporated proposal for Captains Golf Course. DB told the Board that there has been monitoring at the golf course for the last 15 years and there have never been any issues. He explained that the State would like to see more modern turf management products used. He spoke about the cost for a risk manager to review this and also spoke about the need to develop drinking water standards. There will be another test in November. The WQRC will be funding this. Motion: LS-give BOH support to having a study to produce Drinking Water Standards for the Turf Mgmt. at Golf Course. MC seconded. 5 yes. 3. Felco, Inc.-variance requests for 1107 Main Street This is a continued hearing. David Lajoie presented this. The following variances were requested: 1. 2'from SAS to property line (street) 2. 2'from SAS to property line (parcel 52-1) 3. 11'from SAS to cellar wall 4. 48'from SAS to wetland (intermittent stream) NI questioned the number of bedrooms. She believes that it is a 4 bedroom not a 3 bedroom. DL stated that the home is actually 2 units. Conservation has already given approval. JH asked if DL could bring the system to 10 feet from groundwater instead of the 7 it is proposed at now. There was discussion on this issue. It was noted that a 5th variance needed to be requested with regards to the bedroom count. The Board was ok with him verbally requesting it while he was at the meeting. KJ seconded. 5 yes. Motion: MC-approve variances requested with Environmentally Sensitive Area regulations applying, also pending a review of the plan by the Health Director. JF seconded. 5 yes. 4. J.C. Ellis Design Co., Inc.-Variance request for 136 Seaway Road Eric Mitchell presented this to the Board. This is currently a cesspool system. The Following variances were requested: 1. SAS 5'from lot line 2. SAS 14'from foundation wall 3. SAS 76'from wetland Conservation has already approved this project. Motion: MC-approve variances as requested with Environmentally Sensitive Area conditions applying. KJ seconded. 5 yes. 5. Cape Cod Engineering, Inc.-Variance request for 84 Hazel Lane Bob Perry presented this to the Board. This is currently a failed system. The variance being requested is to be allowed to replace the SAS within 300'of a pond. NI had questions about the rooms in the house and upgrading the septic tank. NI stated that approved capacity for this home is 4 bedrooms, BP will be increasing to 5 bedrooms(in accordance with bedroom definition). That would call for him to upgrade the tank to a 1500 gallon one. The Board agreed to continue this hearing for 2 weeks so that BP can get room dimensions for the Board. 6. Grover-Request to renew sand and mining permit; Map 45 Parcels 32 &36 The Board asked NI to notify him that the request has been withdrawn and that there is no permit. 7. Taft-385 Crowell's Bog Road-Request to allow SAS to remain 135'from pond Motion: LS-approve request and allow the SAS to remain 135'from pond. KJ seconded. 5 yes. 8. Steven &Carolyn Graves D/B/A Cake&Islands-application for Food Establishment permit Carolyn Graves explained to the Board that she would like to be able to use existing space at El Guapo's restaurant to bake her cakes. The restaurant is closed for the season so it would just be her there. She would not be having anyone come in, she would be taking requests for cakes and delivering them. Motion: LS-approve Food Establishment application contingent on a final inspection. MC seconded. 5 yes. 9. Continued hearing on 98 Ebenezer Lane Diana Delano told the Board that she had moved out of the house and into senior housing. They were unable to get anyone to help them put in a new septic system. DD asked that she be allowed to go back to the house to get her remaining items out and to clean it. The Board was ok with that and asked that she let NI know when the water was turned off. BOH 11/1/11 Minutes Page 3 10. Discuss Falmouth BOH's policy on repairs and new construction The Board asked that this be brought back to the next work meeting. 11. Discuss Planning Board application—CSR, LLC No BOH issues. Noted. 12. Discuss Planning Board application-Chef Paul's Truffles and Catering NI told the Board that he has to make a formal application to the Health Department and has not done that yet. Add on's NI gave an update on Leanne Trefrey's situation. Bills were signed by the Chairman. Meeting adjourned at 9:10PM a. 1 ,„A
