HomeMy Public PortalAbout08876 O R D I N A N C E NO. 8876 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to Thomas DeGrand, d/b/a PRO AM Driving Range of St. Louis County, Missouri, and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District hereinafter called Lessor, has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for Open Space Purposes, and WHEREAS, Arthur J. DeGrand,Jr., d/b/a/ PRO AM Driving Range, has leased from Lessor a portion of said real property to be used in conjunction with a Golf Driving Range he operated, said lease having been authorized by Ordinance No. 4652, adopted March 3, 1982, and said lease and all options to terminate on April 30, 1990, and WHEREAS, his successor, Thomas DeGrand is desirous of executing a new lease in order to continue the operations on said real property, and WHEREAS, the execution of said lease will not interfere with the Open Space Purposes for which said real property was acquired. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Thomas DeGrand, d/b/a/ PRO AM Driving Range, upon the general terms and conditions hereinafter set forth, the following described real property: The northwest 150 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 150 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of-way. Section Two. The lease term shall commence on December 31, 1992 and continue for five (5) years to December 30, 1997, at the rental of One Hundred Twenty-five Dollars ($125.00) per month, or a net yearly rental of One Thousand Five Hundred Dollars ($1,500.00) with an option to renew this lease for an additional term of five (5) years upon the same terms and conditions. Section Three. The Executive Director and Secretary- Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. The foregoing Ordinance was adopted February 10, 1993.
