AN ORDINANCE, appropriating One Hundred Twenty-four
Thousand Dollars ($124,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek to be used for
project costs for the construction of storm sewers in Carson Road
#841 Storm Sewer (S-2020, C-1347), in the City of Ferguson,
Missouri; and confirming a contract with D. Bennish Construction
Company for the construction of the aforesaid storm sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Eighty-six Thousand Four Hundred Forty Dollars
($86,440.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Thirty-seven Thousand
Five Hundred Sixty Dollars ($37,560.00), and
WHEREAS, the City of Ferguson, Missouri, pursuant to
the Housing and Community Development Act of 1974, has agreed to
contribute Thirty-two Thousand Dollars ($32,000.00) toward the
total costs of said project; upon the receipt of such funds from
said source, said money will be returned to the Operation,
Maintenance and Construction Improvement Fund of Maline Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:

Section One. The sum of One Hundred Twenty-four
Thousand Dollars ($124,000.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of Maline
Creek to be used for project costs for the construction of storm
sewers in Carson Road #841 Storm Sewer (S-2020, C-1347), in the
City of Ferguson, Missouri.
Section Two. The contract heretofore let by the
Executive Director to D. Bennish Construction Company as the
lowest responsible bidder for the construction of storm sewers in
Carson Road #841 Storm Sewer (S-2020, C-1347), in the City of
Ferguson, Missouri, with the Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 8th day of
March, 1993 and formally executed on the 9th day of March, 1993 by
said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
