AN ORDINANCE, appropriating One Hundred Seventy-three
Thousand Two Hundred Fifty Dollars ($173,250.00) from the
Operation, Maintenance and Construction Improvement Fund of Deer
Creek to be used for project costs for the construction of a
reinforced concrete vertical wall channel, a reinforced concrete
box culvert, and storm sewers in Graeser Road #262 (90257), in the
City of Creve Coeur, Missouri; and confirming a contract with
Essex Contracting, Inc. for the aforesaid construction, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for said construction is One Hundred
Twenty-nine Thousand Eight Hundred Sixty-two Dollars
($129,862.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs and
allowance for construction change orders is Forty-three Thousand
Three Hundred Eighty-eight Dollars ($43,388.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Hundred Seventy-three
Thousand Two Hundred Fifty Dollars ($173,250.00) is hereby
appropriated from the Operation, Maintenance and Construction
Improvement Fund of Deer Creek to be used for project costs for
the construction of a reinforced concrete vertical wall channel, a

reinforced concrete box culvert, and storm sewers in Graeser Road
#262 (90257), in the City of Creve Coeur, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Essex Contracting, Inc. as the lowest
responsible bidder for the construction of a reinforced concrete
vertical wall channel, a reinforced concrete box culvert, and
storm sewers in Graeser Road #262 (90257), in the City of Creve
Coeur, Missouri, with The Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 19th day of March,
1993 and formally executed on the 13th day of April, 1993 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
