AN ORDINANCE, appropriating Three Hundred Seventy
Thousand Five Hundred Dollars ($370,500.00) from the Operation,
Maintenance and Construction Improvement Fund of Coldwater Creek
to be used for project costs for the construction of storm sewers
in Davenport Dr. #8201/Aline Ave. #8042 (89012), in the City of
Berkeley, Missouri; and confirming a contract with Karsten
Equipment Company for the construction of the aforesaid storm
sewers, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said storm
sewers is Two Hundred Sixty-five Thousand Eight Hundred Forty-
seven Dollars ($265,847.00), and the cost of engineering,
inspection, construction staking, advertisement costs, easement
costs, and allowance for construction change orders is One Hundred
Four Thousand Six Hundred Fifty-three Dollars ($104,653.00), and
WHEREAS, the City of Berkeley, Missouri, has agreed to
contribute One Hundred Eighty-five Thousand Two Hundred Fifty
Dollars ($185,250.00) toward the total costs of said project; upon
the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES

OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Seventy Thousand
Five Hundred Dollars ($370,500.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Coldwater Creek to be used for project costs for the construction
of storm sewers in Davenport Dr. #8201/Aline Ave. #8042 (89012),
in the City of Berkeley, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Karsten Equipment Company as the lowest
responsible bidder for the construction of storm sewers in
Davenport Dr. #8201/Aline Ave. #8042 (89012) in the City of
Berkeley, Missouri, with the Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 27th day of
April, 1993 and formally executed on the 11th day of May, 1993 by
said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
