AN ORDINANCE, appropriating Five Hundred Fifteen
Thousand Five Hundred Dollars ($515,500.00) from the Operation,
Maintenance and Construction Improvement Fund of Coldwater Creek
to be used for project costs for the construction of storm sewers
in Chaucer & Charjean Stormwater Improvement Phase II (90188), in
the City of Breckenridge Hills, Missouri; and confirming a
contract with J.H. Berra Construction Company, Inc. for the
construction of the aforesaid storm sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Three Hundred Eighty-three Thousand Four Hundred Sixty-
four Dollars ($383,464.00), and the cost of engineering,
inspection, construction staking, advertisement costs, easement
costs, allowance for construction change orders and other costs,
is One Hundred Thirty-two Thousand Thirty-six Dollars
($132,036.00) and
WHEREAS, St. Louis County, Missouri, pursuant to its $5
Million Stormwater Bond Issue Program, has agreed to contribute
Twenty-one Thousand Dollars ($21,000.00) toward the total costs of
said project; upon the receipt of such funds from said source,
said money will be returned to the Operation, Maintenance and
Construction Improvement Fund of Coldwater Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Five Hundred Fifteen Thousand
Five Hundred Dollars ($515,500.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Coldwater Creek to be used for project costs for the construction
of storm sewers in Chaucer & Charjean Stormwater Improvement Phase
II (90188), in the City of Breckenridge Hills, Missouri.
Section Two. The contract heretofore let by the
Executive Director to J.H. Berra Construction Company, Inc. as the
lowest responsible bidder for the construction of storm sewers in
Chaucer & Charjean Stormwater Improvement Phase II (90188), in the
City of Breckenridge Hills, Missouri, with The Metropolitan St.
Louis Sewer District, pursuant to bids received and opened on the
21st day of April, 1993 and formally executed on the 11th day of
May, 1993 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
