HomeMy Public PortalAbout09011 O R D I N A N C E NO. 9011 AN ORDINANCE, amending Ordinance No. 8879, as adopted February 10, 1993, by repealing Section Seven, and enacting in lieu thereof a new Section Seven, pertaining to the bond to be furnished to the District by successful bidders for District improvement projects. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Section Seven of Ordinance No. 8879, as adopted February 10, 1993, is hereby repealed. Section Two. Ordinance No. 8879, as adopted February 10, 1993, is hereby amended by enacting a new Section Seven thereto. Section Seven of Ordinance No. 8879 shall now read as follows: "Section Seven. Bond. Within a reasonable time after award of the contract and prior to execution of the contract documents, the apparent successful bidder shall secure and file with the District good and sufficient bond or bonds with a surety or sureties engaged in the bonding business, authorized under the laws of Missouri to do business in this State, and approved by the District. Said bond or bonds shall be conditioned upon the obligation of the payment by the apparent successful bidder of all persons supplying labor and material in the prosecution of the work provided for in the contract in an amount approved by the District. Provided, however, that for projects less than $50,000, the requirement for said bond or bonds may be waived if so specified in the bid documents and if approved by the Board of Trustees." The foregoing Ordinance was adopted June 9, 1993.
