AN ORDINANCE, appropriating Three Hundred Sixty-one
Thousand Seven Hundred Fifty Dollars ($361,750.00) from the
Operation, Maintenance and Construction Improvement Fund of Deer
Creek to be used for project costs for the construction of a
gabion wall, mattress, and appurtenances in Avignon Ct. -
Beaucaire Dr. Channel Improvement (91066), in the City of Warson
Woods, Missouri; and confirming a contract with Yowell
Construction Company for the aforesaid construction, in compliance
with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the aforesaid construction is Two
Hundred Seventy-eight Thousand Six Hundred Eighty Dollars
($278,680.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is Eighty-three Thousand
Seventy Dollars ($83,070.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Sixty-one
Thousand Seven Hundred Fifty Dollars ($361,750.00) is hereby
appropriated from the Operation, Maintenance and Construction
Improvement Fund of Deer Creek to be used for project costs for
the construction of a gabion wall, mattress, and appurtenances in

Avignon Ct. - Beaucaire Dr. Channel Improvement (91066), in the
City of Warson Woods, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Yowell Construction Company as the lowest
responsible bidder for the construction of a gabion wall,
mattress, and appurtenances in Avignon Ct. - Beaucaire Dr. Channel
Improvement (91066), in the City of Warson Woods, Missouri, with
The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 6th day of December, 1993 and formally
executed on the 13th day of December, 1993 by said contractor and
by the Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
