HomeMy Public PortalAbout09166 O R D I N A N C E NO. 9166 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict; and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict, and that the interests of sanitation and public health of the District and the Subdistrict will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District and the Fee Trunk Sewer Subdistrict, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. The foregoing Ordinance was adopted January 12, 1994. 2 Ordinance No. 9166 EXHIBIT 'A' An area of land being requested for annexation into the Metropolitan St. Louis Sewer District, and being comprised of several tracts of land being part of Section 1, Township 44 North, Range 3 East; St. Louis County, Missouri and being more particularly described as follows: Beginning at the point of intersection of the centerline of Old Eatherton (40 feet wide) Road and the northern right-of-way line of Manchester (60 feet wide) Road, said point also being the northeastern corner of the existing M.S.D. boundary per M.S.D. Ordinance No. 7473; thence northerly along said centerline of Old Eatherton (40 Feet wide) Road, also being the western M.S.D. May 1977 boundary, 105 feet, more or less, to a point; thence leaving said centerline and said western M.S.D. May 1977 boundary westerly 20 feet to a point in the western right-of-way line of said Old Eatherton Road, said point also being the northeastern corner of a tract of land known as "PARCEL A" now or formerly conveyed to Julius G. and Ilona Viraghaty by deed recorded in Book 7015, Page 1379 of the St. Louis County Recorder's Office; thence westerly along the northern line of said "PARCEL A", also being the southern line of a tract of land known as "PARCEL B" now or formerly conveyed to Julius G. and Ilona Viraghaty by deed recorded in Book 7015, Page 1379 of said Recorder's Office, 105 feet, more or less, to a point in the eastern line of a tract of land now or formerly conveyed to Robert S. and Helen N. Pisarkiewicz by deed recorded in Book 9009, Page 1975 of said Recorder's Office, said point also being the northwestern corner of said "PARCEL A" and the southwestern corner of said "PARCEL B"; thence northerly along the eastern line of said Pisarkiewicz tract, also being the western lines of said "PARCEL B" and tracts of land now or formerly conveyed to Wanda Kay Mckown by deed recorded in Book 8413, Page 1906 and to John C. and Daphine R. Covert by deed recorded in Book 8049, Page 977, of said Recorder's Office, 315 feet, more or less, to the northeastern corner of said Pisarkiewicz tract; thence westerly along the northern line of said Pisarkiewicz tract, also being the southern line of said Covert tract, 121 feet, more or less, to a point in the eastern line of a tract of land now or formerly conveyed to Alan W. and Sharon L. Quaethem by deed recorded in Book 8174, Page 1658 of said Recorder's Office, also being the northwestern corner of said Pisarkiewicz tract; thence southerly along the western line of said Pisarkiewicz tract, also being the eastern lines of said Quaethem tract and tracts of land now or formerly conveyed to Paul A. and Anna M. Hale (no deed of record) identified by St. Louis County locator number 24V 53 0131 and to Edward F. and Grace Stricker by deed recorded in Book 8892, Page 1214 of said Recorder's Office, 220 feet, more or less, to the southeast corner of said Stricker tract, also being the northeast corner of a tract of land now or formerly conveyed to Annie Rickard (no deed of record) identified by St. Louis County locator number 24V 51 0287; thence westerly along the northern line of said Rickard tract, also being the southern line of said Stricker tract, 200 feet, more or less, to a point in the eastern right-of-way line of Lindy (25 feet wide, private) Lane, also being the northwestern corner of said Rickard tract and the southwestern corner of said Stricker tract; thence westerly along the projection of said northern line of said Rickard tract, 25 feet, more or less, to its intersection with the western right-of-way line of said Lindy (25 feet wide, private) Lane, said intersection also being the northeastern corner of a tract of land now or formerly conveyed to Leslie L. Cremins by deed recorded in Book 6566, Page 1519 of said Recorder's Office, 1310 feet, more or less, to its intersection with the northern right-of-way line of Manchester (60 feet wide) Road, said point also being the southwestern corner of said Greenberg-Blatt Management tract; thence southeasterly and easterly along said northern line of said Manchester (60 feet wide) Road on a curve to the left and tangent, also being the southern lines of said Greenberg-Blatt Management tract and aforesaid Strode tract and Bauer tract and Trumble tract and Covert Corsair Homes, Inc. tract and Bray tract, 877 feet, more or less, to its intersection with the western right-of-way line of the aforesaid Lindy (25 feet wide, private) Lane; thence easterly along said northern right-of-way line of said Manchester Road, 25 feet, more or less, to its intersection with the eastern right-of-way line of said Lindy Lane, said intersection also being the southwestern corner of aforesaid Rickard tract; thence easterly along said northern right-of-way line of said Manchester Road, also being the southern lines of said Rickard tract and the aforesaid Pisarkiewicz tract and Viraghaty tract, and the northern line of existing M.S.D. boundary per M.S.D. Ordinance No. 7473, 426 feet, more or less, to its intersection with the western right-of-way line of aforesaid Old Eatherton (40 feet wide) Road; thence along the said northern right-of-way line of said Manchester Road, 20 feet, more or less, to its intersection with the centerline of said Old Eatherton Road and point of beginning and containing 24.3 acres, more or less, subject to easements, conditions, restrictions and reservations of record, if any.
