HomeMy Public PortalAbout09167 O R D I N A N C E NO. 9167 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict; and WHEREAS, petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict, and that the interests of sanitation and public health of the District and the Subdistrict will be promoted by including the area in their respective territories; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer or drainage facilities of the District and the Fee Fee Trunk Sewer Subdistrict can efficiently serve the area described in Exhibit A, as attached hereto. Section Two. That petitions signed by a majority of the owners of the land in said area, who are also the owners of more than one-half of the land area therein, praying for annexation of said area by The Metropolitan St. Louis Sewer District and by the Fee Fee Trunk Sewer Subdistrict and setting forth the boundaries of the area to be annexed have been filed with and received by the Board of Trustees of The Metropolitan St. Louis Sewer District. Section Three. That the interests of sanitation and public health of the District and the Fee Trunk Sewer Subdistrict, as well as the area proposed to be annexed, will be promoted by including said area in their respective territories. Section Four. That the sewage flow from the area proposed to be annexed has no other available adequate sewer outlet or treatment facility. Section Five. That the Board of Trustees, after examination and consideration of the facts, hereby grants the petition for annexation of said area, and hereby declares that the corporate boundaries of The Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer Subdistrict are hereby respectively extended so as to include the area described in Exhibit A, as attached hereto. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. The foregoing Ordinance was adopted January 12, 1994. 2 Ordinance No. 9167 EXHIBIT 'A' A tract of land situated in Section 12, Township 44 North, Range 3 East, St. Louis County, Missouri conveyed to John and Irma Holt by deed recorded in Book 7550, Page 1709 of the St. Louis County, Missouri Recorder's Office, and being more particularly described as follows: Beginning at a point in the southern Right-Of-Way of Manchester Road (60 feet wide), said point being the northeastern corner of said Holt tract; thence South 00 degrees 56 minutes 37 seconds West, 384.58 feet along the eastern line of said Holt tract also being the western line of a tract of land now or formerly conveyed to Manchester Woods Corp. by deed recorded in Book 8007, Page 166, and a tract of land now or formerly conveyed to DAU The House Furnisher, Inc. by deed recorded in Book 8291, Page 272 of said Recorder's Office to the southwest corner of said DAU The House Furnisher, Inc. tract; thence along the northern line of said Holt tract, also being the southern line of said DAU The House Furnisher, Inc. tract, and a tract of land now or formerly conveyed to R & G Partnership by deed recorded in Book 8534, Page 233, the following bearings and distances: South 67 degrees 01 minutes 05 seconds East, 156.42 feet; South 51 degrees 00 minutes 59 seconds East, 98.96 feet; South 54 degrees 49 minutes 53 seconds East, 110.76 feet; North 84 degrees 40 minutes 11 seconds East, 59.40 feet; North 32 degrees 40 minutes 11 seconds East, 18.24 feet; and South 73 degrees 01 minutes 18 seconds East, 27.71 feet to a point in the centerline of Woods Road (40 feet wide); thence along said centerline of Woods Road, also being the eastern line of said Holt tract, and the western line of a tract of land now or formerly conveyed to John and Helen Madlinger by deed recorded in Book 8861, Page 1108, the following bearings and distances: South 01 degrees 49 minutes 50 seconds East, 122.78 feet; South 06 degrees 16 minutes 20 seconds West, 53.69 feet; South 21 degrees 58 minutes 12 seconds West, 103.99 feet; South 46 degrees 29 minutes 24 seconds West, 195.69 feet; South 50 degrees 31 minutes 36 seconds West, 55.10 feet; South 40 degrees 27 minutes 09 seconds West, 36.87 feet; South 08 degrees 44 minutes 52 seconds West, 36.76 feet; and South 04 degrees 38 minutes 08 seconds East, 20.25 feet to the southeastern corner of said Holt tract; thence leaving said centerline of Woods Road northwesterly along the southern line of said Holt tract, also being the northern line of a tract of land now or formerly conveyed to Walter and Anita Cartwright by deed recorded in Book 9223, Page 572, North 54 degrees 36 minutes 27 seconds West, 195.59 feet to a point; thence continuing along said common southern and northern line North 75 degrees 01 minutes 21 seconds West, 190.75 feet to the southwestern corner of the said Holt tract, also being the southeastern corner of a tract of land now or formerly conveyed to Harry and Clark Funk by deed recorded in Book 2124, Page 204; thence North 00 degrees 26 minutes 58 seconds East, 523.15 feet along the western line of said Holt tract, also being the eastern line of said Funk tract, to a point in the southern line of a tract of land now or formerly conveyed to Cliff Rufkahr Farm & Pet Supply by deed recorded in Book 8558, Page 1841, said southern line also being an existing M.S.D. boundary line per M.S.D. Ordinance No. 7868; thence South 89 degrees 57 minutes 51 seconds East, 125.00 feet along the said southern line and said existing M.S.D. boundary to the southeastern corner of said Cliff Rufkahr Farm & Pet Supply tract; thence North 00 degrees 30 minutes 05 seconds East, 400.00 feet along the western line of said Holt tract, also being the eastern line of said Cliff Rufkahr Farm & Pet Supply tract and existing M.S.D. boundary per M.S.D. Ordinance No. 7868, and the eastern line of property as conveyed to Cherry Hills Square, Inc. and recorded in Deed Book 8346, Page 447, and an existing M.S.D. boundary line per M.S.D. Ordinance No. 7473, to a point in the southern Right-Of-Way line of Manchester Road, (60 feet wide), said point also being the northeastern corner of said Cherry Hills Square, Inc. tract, and the northwestern corner of said Holt tract; thence along said southern Right-Of-Way line of Manchester Road, said line also being an existing M.S.D. boundary line per said M.S.D. Ordinance No. 7473 and the northern line of said Holt tract, to the point of beginning and containing 7.28 acres more or less.
