AN ORDINANCE, appropriating a total of One Million One
Hundred Fifty Thousand Dollars ($1,150,000.00), to be funded as
follows: Three Hundred Fifty-eight Thousand Seven Hundred Dollars
($358,700.00) from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek, and Seven Hundred Ninety-one
Thousand Three Hundred Dollars ($791,300.00) from the Coldwater
Creek Sewer Extension and Improvement Fund, to be used for project
costs for the construction of sanitary sewers in Upper Coldwater
Creek Sanitary Relief Section E Phase IB-2 (93083), in the City of
St. Ann, Missouri; and confirming a contract with Bates Utility
Co. for the construction of the aforesaid sanitary sewers, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Nine Hundred Seventy-five Thousand Two Hundred Fifteen
Dollars ($975,215.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement costs, and
allowance for construction change orders is One Hundred Seventy-
four Thousand Seven Hundred Eighty-five Dollars ($174,785.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of One Million One Hundred
Fifty Thousand Dollars ($1,150,000.00), to be funded as follows:

($358,700.00) from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek, and Seven Hundred Ninety-one
Thousand Three Hundred Dollars ($791,300.00) from the Coldwater
Creek Sewer Extension and Improvement Fund, is hereby appropriated
to be used for project costs for the construction of sanitary
sewers in Upper Coldwater Creek Sanitary Relief Section E Phase
IB-2 (93083), in the City of St. Ann, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Co. as the lowest responsible
bidder for the construction of sanitary sewers in Upper Coldwater
Creek Sanitary Relief Section E Phase IB-2 (93083), in the City of
St. Ann, Missouri, with The Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 22nd day of December,
1993 and formally executed on the 11th day of January, 1994 by
said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
