AN ORDINANCE, vacating a portion of a sewer easement in part of
Lot 1 of Nooney's Commercial Subdivision of Ferguson, in the City of Ferguson,
St. Louis County, Missouri.
WHEREAS, the owner of the subject property has agreed to grant to
the District a suitable alternate easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sewer easement described below, with the
exception of any portion coinciding with the easement recorded in Deed Book
9939, Pages 96 and 97 of the St. Louis County Records, is hereby vacated, to
wit:
A tract of land being 10.00 feet in width located over, across, and
through a tract of land, being part of Lot 1 of Nooney's
Commercial Subdivision of Ferguson, as recorded in Plat Book 98,
at Page 29 of the St. Louis County Records, said tract as conveyed
to S & A Realty Company, a Missouri Corporation by instrument
recorded in Book 7479 at Page 214 of above said records, said
easement being established by instruments as recorded in Book 3186
at Page 302 and Book 5577 at Page 582 of the above said records,
and being more particularly described as follows:
Commencing at the Northeasterly most corner of above said Lot 1; thence
South 81 degrees 43 minutes 30 seconds West along the Northerly
line of said Lot 1, and the Northerly line of above said S & A
Realty Company Tract, a distance of 60.00 feet to the Point of
Beginning of the herein described tract; thence South 08 degrees
16 minutes 30 seconds East 200.00 feet to a point in the Southerly
line of above said S & A Realty Company Tract; thence South 81
degrees 43 minutes 30 seconds West along said Southerly line 10.00
feet; thence departing said Southerly line North 08 degrees 16
minutes 30 seconds West 200.00 feet to a point in the Northerly
line of above said Lot 1 and the Northerly line of said S & A
Realty Company Tract; thence North 81 degrees 43 minutes 30
seconds East along last said Northerly lines 10.00 feet to the
Point of Beginning and containing 2,000 square feet more or less.
The foregoing Ordinance was adopted May 11, 1994.
