HomeMy Public PortalAbout1994-10 Amending Section 30 - 54 of the code re Installation of septic tanksORDINANCE NO. 94-10 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; AMENDING SECTION 30-54 OF THE CODE OF KEY BISCAYNE; PROHIBITING THE FILLING OF LOTS TO AN ELEVATION OF MORE THAN 2.5 FEET ABOVE THE CROWN OF THE ADJACENT ROADWAY; PROVIDING FOR AN EXCEPTION RELATING TO SEPTIC TANKS; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, DADE COUNTY, FLORIDA, AS FOLLOWS: Section 1. That Section 30-54 of the Code of Key Biscayne is hereby amended to read as follows:' Sec. 30-54. Lot Elevation Where a lot is filled for development purposes, the portion of the lot lying between the property lines and the building 3ctback3 may not be filled to an elevation greater than onc and onc half 2.5 feet below the BFE above the crown of any dedicated roadway adjacent to subject property, unless additional fill is required for the installation of a septic tank in accordance with applicable regulations.,and nNo first story patio, deck or pool permitted under section 30- 58(a) and 30-58(b) shall exceed said 2.5 foot elevation in thi3 arca. Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of 'Underlined words are additions to text, word3 Struck through are deletions to text. the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances, Village of Key Biscayne; that the sections of this Ordinance may be renumbered or relettered to accomplish such intention; and that the word "Ordinance" may be changed to "Section" or other appropriate word. Section 4. Effective Date. This Ordinance shall be effective upon adoption on second reading. PASSED AND ADOPTED on first reading this 13th day of December , 1994.
