O R D I N A N C E NO. 9290
AN ORDINANCE, appropriating a total of Seven Hundred
Thousand Dollars ($700,000.00), to be funded as follows: Five
Hundred Three Thousand Dollars ($503,000.00) from the Operation,
Maintenance and Construction Improvement Fund of Maline Creek, and
One Hundred Ninety-seven Thousand Dollars ($197,000.00) from the
Sanitary Replacement Fund, to be used for project costs for the
construction of sanitary sewers in Infrastructure Repair #036
Norlakes Dr. & Oakmont Sanitary Relief (91065), in the City of
Ferguson, Missouri; and confirming a contract with Yowell
Construction Company for the construction of the aforesaid sanitary
sewers, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said sanitary
sewers is Five Hundred Seventy-one Thousand Eight Hundred Eighty-
two and 50/100 Dollars ($571,882.50), and the cost of engineering,
inspection, construction staking, advertisement costs, easement
costs, and allowance for construction change orders is One Hundred
Twenty-eight Thousand One Hundred Seventeen and 50/100 Dollars
($128,117.50), and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of Seven Hundred Thousand
Dollars ($700,000.00), to be funded as follows: Five Hundred Three
Thousand Dollars ($503,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek, and One Hundred
Ninety-seven Thousand Dollars ($197,000.00) from the Sanitary
Replacement Fund, is hereby appropriated to be used for project
costs for the construction of sanitary sewers in Infrastructure
Repair #036 Norlakes Dr. & Oakmont Sanitary Relief (91065), in the
City of Ferguson, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Yowell Construction Company as the lowest
responsible bidder for the construction of sanitary sewers in
Infrastructure Repair #036 Norlakes Dr. & Oakmont Sanitary Relief
(90165), in the City of Ferguson, Missouri, with The Metropolitan
St. Louis Sewer District, pursuant to bids received and opened on
the 20th day of June, 1994 and formally executed on the 12th day of
July, 1994 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted August 10, 1994.
