SUBJ: Planning Department Updates for June 9, 2009 Commission Meeting
Ordinance Updates
A) CUP Standards for Religious Institutions — the ordinance was reviewed by the City
Council at the May 5 and June 2 meetings, and they directed staff to make a number of
changes and provide additional information on intensity regulations and parking
requirements. The ordinance and rezoning will be on the Council agenda on June 16.
B) Animal Unit Density Standards — staff will prepare amendments as directed by the City
Council for the RR zoning district regulations. The Planning Commission will hold the
Public Hearing at the June meeting.
C) Private Recreation Zoning District — the ordinance will be placed on a future agenda
after the Council has acted on the Public/Semi-Public zoning ordinances.
D) General Business and Industrial Ordinances — the ordinance will be placed on a future
agenda following Council action on the PREC ordinance.
Land Use Application Reviews
A) Holy Name Cemetery — The City Council approved resolutions for the lot combination,
CUP/Site Plan, Interim Use Permit and easement vacation. City legal staff is working
with the applicant to get all necessary documents recorded correctly.
B) Wrangler's Restaurant — 32 Hamel Road — The Planning Commission held a Public
Hearing at their May 12 meeting, and recommended approval. The item was scheduled
for the June 2, 2009 City Council meeting for review, but the applicant intends to
change the site plan again. The item is up for review again at the June Planning
Commission meeting.
C) Adam's Pest Control — 872 Highway 55 — The applicant originally applied for a Site
Plan Review to replace the existing shed on the property and make other site
improvements. The applicant has reassessed their application, and is not going to
proceed because of uncertainty with construction and review costs.
D) Woodridge Church — 1500 County Road 24 — the applicant has provided an extension
that extends 60 days following the completion of the moratorium. They plan to be
active in the discussion regarding the updated ordinance regulations.
Additional Projects
A) Comprehensive Plan Update — Staff resubmitted the Update back to the Metropolitan
Council for review. The Plan, as submitted, is available on the City's website. The Met
Council informed staff that the submittal is still incomplete. Staff vehemently disagrees,
and believes that the things being requested could easily be conditioned on approval.
Nonetheless, staff is making additional changes and plans to resubmit (again) very soon.

Tuesday, May 12, 2009
1. Call to Order: Commissioner Nolan called the meeting to order at 7:00 p.m.
Present: Planning Commissioners, Charles Nolan, Robin Reid, Victoria Reid, Beth Nielsen, Jim
Simons and Mary Verbick.

2. Public Comments on Items not on the Agenda:
No public comments.
3. Update from City Council Proceedings:
Weir updated the Commission that the City Council:
- Recognized Police Officer Tom Gregory for five years of service in Medina;
- Accepted a check for $30,000 from the West Metro Drug Task Force. The check is
Medina's distribution from last years drug -related confiscations and helps to pay for our
officer's time. The Task Force is preventing millions of dollars -worth of drugs from
entering west suburban streets and schools;
- Held a public hearing and approved resolutions for the 2009 mill and overlay road project
for Cherry Hills and Elm Creek Drive, with costs partially assessed to benefiting
properties;
Approved the new Medina logo;
Held a public hearing on our Storm Water Pollution and Prevention Program and
recognized the multiple initiatives of our Pubic Works Department to reduce
phosphorous -bearing run-off into lakes;
Approved a contract with Hagen, Christensen and McIlwain Architects Field to design
and build the Field House in Hamel Legion Park;
Reviewed a projected budget update for 2009 and expect to be virtually on target this
year. If projections hold true, the City projects a $4,500 deficit in a budget of $3.6
million. Building application activity, or lack of it, in the next few months will help to
determine projections for year 2010 budgetary planning;
- Discussed the proposed Public/Semi-Public zoning ordinance and how to resolve the
conflicting purposes of RR zoning district and the increasing intensity of use -needs of
religious institutions. Council tabled the ordinance until June 6 and directed staff to come
back with workable suggestions for limiting intensity of use, with particular regard to
parking in the RR zoning district.

- Approved the Holy Name Cemetery lot combination, CUP, Site Plan Review, Interim
Use Permit and Easement Vacation with all recommendations of the PC;
- Directed staff to do a total financial analysis of the future costs of administering and
managing the German Liberal Cemetery, with a possible view to the City taking it over;
Discussed park signage and a possible sign to direct traffic up Sioux Drive to Uptown
Hamel;
Directed staff to add to its ordinance -tidying -list the removal of ash trees from the list of
recommended tree species in the Tree Preservation Ordinance.
- Thank you very much to everyone who volunteered on Clean-up Day.
4. Planning Department Report:
Finke updated the Commission on future projects and ordinances:
• Agenda for next month may be Adam's Pest Control Property @ 872 Highway 55 for
CUP Amendment and Site Plan Review for a new accessory structure and renovation of
existing principal structure along with site improvements.
• Text Amendment to the Rural Residential ordinance animal units.
• Resubmitted plans to the Metropolitan Council which should start the time clock for their
review. Medina is well ahead of most communities in the metro.
• Staff continues to work on ordinances.
V. Reid asked what needed changing with the Comprehensive Plan for the Metropolitan Council.
Finke explained that it related to inconsistencies within the document.
Weir explained the Minnehaha Watershed's request for increased density in the year 2030.
5. Approval of April 14, 2009 Planning Commission Minutes:
Motion by Verbick, seconded by Nielsen to approve the April 14, 2009 minutes with
recommended changes. Motion carried unanimously. (Absent: Litts)
6. Public Hearing: Wranglers Restaurant — David Willis (PIDs 12-118-23-41-
0012, 12-118-23-41-0013 & 12-118-23-41-00014) — Preliminary Plat to
combine two lots and Site Plan Review to construct a parking lot for a
proposed restaurant/bar.
Finke presented the application explaining the zoning, land use guidance and request of the
applicant. He explained that the City has supported combining small lots in Uptown Hamel in
the past though the property has the possibility of requiring a residential component for future

construction on the balance of the property if an application is requested for additional
development/uses.
Verbick asked if the City would have the flexibility to require a residential component in the
future. Finke explained the intent is to rezone the entire UH area to either UH1 or UH2 with
further conversations to come to determine which district.
V. Reid asked if the owners could expand the business in the future without the residential
component. Finke explained that if the owners want to expand the existing building it would
depend on the regulations established at that time.
Nielsen asked when the rezoning for the UH area would occur. Finke explained that large
segments would be rezoned when the residential districts are complete. The rezoning for UH
would be part of an overall rezoning throughout the City with notices mailed out to all property
owners impacted. Weir explained the Comprehensive Plan could also have an impact on timing
of the rezoning.
Nolan asked if an expansion of an existing use occurred would there be a measure to allow an
expansion without constructing the residential component. Finke explained the language says
"new development". V. Reid asked for clarification. Finke explained that a new use would
trigger the residential component and an expansion would need to be reviewed and determined.
Nolan asked if there's a way to get clarity of the residential use component. Finke explained that
under the conditions section of the staff report staff put a statement within it rather than a
condition mentioning the future possibility of a residential component if the existing building
expands.
Willis asked what his property is currently zoned. Finke said Uptown Hamel.
Finke explained the plat met requirements and the property does not have wetlands nor is it
within a floodplain. He explained the easements on the lot and reviewed the criteria for a site
plan review and that the parking lot triggers the need for a site plan review. Currently bars and
restaurants are permitted uses in the UH district which does not require a residential component.
Staff recommended an additional condition be included to put the owners on notice that if the
property is rezoned in the future to require a residential component the property owners would
have to comply if they wanted additional changes or added uses in the future.
Finke reviewed the commercial landscape requirements and recommended additional plantings
adjacent to the parking lot to break up the wall/trash enclosure area.
Finke said the parking requirements are being met with 12 stalls. Additional landscaping is not
recommended due to the future development of the property. He raised concern with
circulation/loading and recommends a condition of approval. He further explained the site is
designed to direct run-off from the parking lot to the City stormwater system. The City Engineer
noted the north end of the lot should be re -designed. Finke reviewed utilities, lighting,
recycling/trash facilities, mechanical equipment, and the bar cooler for the project with the

Commission. He explained the applicant proposed a cedar board trash enclosure and staff
recommended hardi-board siding for long term appearance and maintenance.
Finke recommended two additional conditions to be added under the conditions list as previously
discussed.

Verbick said the lot combination is a logical plan for the possible future development of the area
in Uptown Hamel.
Motion by V. Reid, Seconded by Verbick, to recommend approval of the Preliminary and
Final Plat with conditions as recommended.
Site Plan Review
Nielsen asked what the occupancy is for the building. Finke explained the seating occupancy.
He had concern with the possibility of overflow parking on nonpaved areas. Nielsen counted 13
spaces with one being handicap rather than the 12 noted on the plan. Nolan asked if the fire
department reviewed land use application and Finke explained they don't review occupancy
loads at this point in the process.
Simons asked Finke if he had additional comments on exterior materials. Finke explained the
rational behind the hardi-board recommendation rather than cedar.
Verbick asked if the applicant had a concern with the recommended hardi-board for the trash
enclosure. Willis, applicant, said it didn't matter to him if the material is cedar or hardi-board.
R. Reid asked if the west portion of the lot would be mowed and maintained since it is not
proposed to be paved or landscaped. Willis said he would maintain/cut the unpaved areas on a
regular basis to keep it looking good at all times.
Verbick asked if the hard surfaced parking lot would be permanent or temporary. Finke
responded that it would be permanent. Verbick asked if there are easier LID projects that would
work for this application.
Finke explained the difficulty of installing LID on the parcel at this time.
Nielsen asked when the applicant plans to open. Willis stated approximately August of this year.
Nolan questioned if anything made sense on the western portion of the property related to LID.
Finke further explained the difficulty. Nolan asked about the 5% required to be landscaped or a
plaza. Finke explained the green area equates to landscaped area. As defined, the entire

undeveloped western portion of the lot qualifies. Nolan asked what specific vegetation is
required. Finke asked the Commission to discuss additional landscaping. Nolan asked the
applicant to consider a less industrial looking light fixture. Willis stated they would look into it
further.
R. Reid said the driveway width appeared wide and asked if it was for fire code. Finke explained
that likely the drive aisle would be shared with the property to the west and it could be reduced
to 20 feet, but the applicant's engineer had requested 24 feet.
R. Reid said she would like to see the drive aisle narrower than 24 feet if it could be allowed.
Willis stated that he would agree to narrow it and it would not be an issue. Finke stated the
minimum width is 20 feet.
Robin Reid asked about quality and maintenance of hardi-board. Peterson -Dufresne explained
quality and maintenance of both cedar and hardi-board.
Finke explained cedar is a permitted material for a fence.
The Commission concluded that the project should have additional conditions such as, a 20 foot
drive aisle, parking shall be limited to paved surfaces only, the undeveloped portion of the lot
shall be maintained, and hardi-board is preferred as recommended by staff rather than cedar.
Motion by Simons, Seconded by R. Reid to recommend approval of the Site Plan Review
with additional conditions as noted by the Commission (absent Litts).

Summary
The Planning Commission reviewed and recommended approval of a Plat and a Site Plan
Review at 32 Hamel Road at its May meeting. The applicants (David and Jim Willis) ha
amended the Site Plan to add a 990 square foot addition to the back of the existing structure. The
applicant also proposes to construct a larger parking lot with 32 parking stalls. This size of an
addition and an expansion of parking of this amount both require a Site Plan review in the
Uptown Hamel zoning district. The applicants have not changed the Plat, so it was not necessary
to send notice for another Public Hearing on this subject.
Staff recommends approval of the Site Plan Review, with the recommended conditions at the end
of this staff report.

Site Plan Review
The Uptown Hamel zoning ordinance requires a Site Plan Review in this situation because of the
following factors: 1) proposed change in use to a more intensive use -in this case from retail to
bar/restaurant; 2) increase in parking of more than 4 spaces; and 3) change in topography.

The purpose of a Site Plan Review is "to determine whether it is consistent with the requirements
of this ordinance, including the applicable development standards and the purpose of the zoning
district in which the property is located. Following the review, the planning commission shall
recommend that the site plan be approved, approved with conditions or denied."
Proposed Use
As discussed last month, bar and restaurant uses are both permitted uses in the UH zoning
district. The applicant will need to stay current with liquor licensing requirements, which staff
has noted as a recommended condition. No outdoor seating area is proposed at this time. The
UH zoning district allows an area no more than 200 square feet in size. Staff has recommended
some conditions to regulate this potential use should it ever arise.
Also as discussed last month, staff has noted that the concept plan in the existing UH ordinance
identifies two of the three lots which are proposed to be combined as a future High Density
housing. Future new construction may be required to include a residential component,
depending on the zoning district regulations in place at that time. Staff recommends that this fact
be recognized in the resolution for Site Plan approval, so that the information is available for all
interested parties.
Site Plan
The proposed site plan is below, and full plans are attached. The proposed 990 square foot
addition is on the north end of the building. A 32-stall parking lot is proposed behind and to the
northwest of the existing structure, with a driveway accessing off of Hamel Road. The
southwestern portion of the lot is proposed to be vacant. This area is meant to either sell off for
another building site (after it is re -subdivided), or the applicants may expand their building in the
future.

As discussed last month, the existing building exceeds the maximum front setback. The
applicant is not proposing to increase this non -conformity, so staff recommends approval of the
Site Plan Review.
Building Design Standards
Building Materials
The exterior building material is proposed to be fiber cement siding (hardi board), matching the .
existing structure. Fiber cement siding is not listed as a permitted exterior material, but is high
quality and durable. The appearance is also similar to a wood siding, which is permitted in the
UH district. The Planning Commission appeared to support this material when proposed for the
enclosure last month. The Commission may wish to make a recommendation of adding fiber
cement siding as an allowed material if they are supportive. If the Commission is not supportive
of fiber cement siding, a condition could be added requiring a material which is allowed. If fiber
cement siding is allowed, staff recommends requiring that it be impregnated with the correct
color so it does not need to be painted.
Building Height
The existing structure is 12 feet in height, and a gross distance of 14 feet from grade to top of
peak. This is well under the three stories permitted. The screen for the rooftop equipment is
lower than the existing peak.
Porches
The ordinance requires a porch or overhang at least six feet in width. The building has an
overhang on the front which is less then 6 feet in width. This approaches the architectural design
element sought by the ordinance, although it is narrower. Staff does not recommend a condition
to expand this overhang, since changes are not proposed to the front of the building.
Mechanical Equipment
The UH ordinance requires that equipment shall not be mounted on the roof unless it can be
demonstrated that there is no other reasonable alternative. If allowed, the rooftop equipment
must be screened with architectural elements and materials consistent with the design standards.
Staff believes there are reasonable alternatives to locate mechanical equipment in another
location besides the roof. The applicant can make an argument for the need for the rooftop

equipment. The applicant does propose to screen the equipment with materials matching the
building.
Fenestration and Modulation
The UH ordinance requires that "windows...shall be generous especially on the street side..."
and also that "building faces and layout shall be modulated to avoid long building walls without
breaks and monotony."
Staff believes that the addition could be improved with respect to these requirements. Staff does
note that the addition is almost entirely utilized for service uses (kitchen, mechanical, restrooms)
and that large windows are probably impractical. However, staff recommends utilizing either
spandrel glass or small, elevated windows to break up the fa9ades of the addition. Another
option may be to install an area similar to the brick design to match the front of the structure in
order to break up the fa9ades.
Landscaping
The UH district requires at least 5% of the site to be plaza or landscaped. Landscaping shall
consist of a combination of: decorative deciduous and coniferous trees, shrubs, flowers, ground
covers and rain gardens. The Tree Preservation ordinance applies to the application. The
applicant proposes to remove two trees, which is allowed in the ordinance.
The proposed landscaping has been significantly increased since the May Commission meeting.
The applicant proposes to plant two overstory Hackberry trees and three decorative Serviceberry
trees. Additionally, 73 shrubs are proposed adjacent to the parking lot. The site also has 12
existing shrubs in the front of the building. The UH ordinance does not require a specific
number of trees or shrubs. The commercial ordinance recently adopted by the City requires one
tree per 50 feet of site perimeter and one shrub per 30 feet. If the property was zoned
commercial, approximately 12 trees and 20 shrubs would be required.
Parking/Circulation/Loading
The applicant proposes 32 parking stalls behind the existing building. The bar and restaurant is
proposed to have 49 seats, and the parking ordinance requires 17 parking stalls.
The UH district does not include a minimum parking setback. However, staff recommends that
the parking lot be set back at least outside of easements. The proposed parking lot meets this
requirement. The UH ordinance disallows parking in front of a building, and the proposed site
plan is consistent with this requirement.
The UH ordinance requires 3% (in this case, 285 square feet) of the parking lot area to be
landscaped. The applicant proposes a 190 square feet island with hardwood mulch within the
parking lot. There are landscaped bump -outs into the parking lot (for example, at the northeast
corner or the western side), but these areas are not part of the parking area. Staff recommends
additional landscaping in the parking lot, with the potential of implementing an LID practice (see
below for further discussion).

In terms of pedestrian circulation, the building is proposed to have an entrance/exit on both the
front and rear of the building. Without the rear door, staff would have recommended a sidewalk
to circulate customers from the parking lot to the front of the building.
Staff believes the updated site plan significantly improves the loading capabilities and circulation
of the site. Staff does note that parking stalls will be blocked during deliveries, but the applicant
has stated that deliveries would be outside of business hours and could be accommodated in the
driveway and parking lot. The UH district does not require loading docks, because of the
constraints on the property in the district. Staff believes that the newly designed parking lot is an
improvement, but still recommends a condition requiring that loading and deliveries not impact
traffic on Hamel Road. Additionally, staff believes that garbage and recycling pick-up would
likely be easier if the enclosure was located along the eastern property line.
Site Drainage/Stormwater/Grading
The property was part of the Uptown Hamel stormwater improvements. The site was designed
to contain most of the run-off over the parking lot and into a stormwater pipe on the north side of
the property. From there, the water is piped to the pond in Stormwater Nature Area.
Utilities
Public Works and Engineering reviewed the proposed utility plan and provided comments,
which are added as a condition of approval. The applicant will run a new water service to the
building for a fire sprinkling system. The applicant will be required to pay necessary sewer and
water connection fees as described by the fee schedule for this intensity of use.
Lighting
The applicant proposes a light pole with two fixtures to light the parking lot. The pole is
proposed to be 20 feet in height. The lighting ordinance (Section 829) allows a maximum of 0.8
Foot Candle (FC) of light at the property line, and 0.2 FC after the business closes. The
applicant has provided a photometric plan. Light on the eastern property exceeds 0.2 FC, so staff
recommends a condition requiring the lights to be extinguished when the business is closed.
Recycling and Trash Facilities;
The UH district requires that all facilities for recycling and trash be kept inside the principal
buildings or within a completely screened area. If a completely screened area is used it must
1) be architecturally compatible with and made of the same or better material used on the
principal building, and 2) meet the architectural and development standards of the district.
The applicant has proposed an enclosure on the north side of the parking lot to screen the
trash/recycling facilities. The trash and recycling screening fence is proposed to be six feet in
height, constructed of cement block with matching hardi-board siding to the addition, with a
cedar gate. Staff believes the enclosure is compatible with the building.
Staff also recommends the following conditions: 1) the trash enclosure shall be large enough for
both trash and recycling containers, and 2) the enclosure shall be tall enough to screen all
dumpsters and equipment.

Low Impact Development
The proposed site plan does not include low impact development (LID) best management
practices. As noted above, the proposal utilizes the stormwater improvements in the area, which
the property was assessed for in 2006.
Staff believes that there is an opportunity to expand the landscaping island in the parking lot and
to place is below the grade of the parking lot. The slope of a portion of the parking lot could
then be changed to direct at least a portion of the run-off through this area. The applicant could
design a vegetative swale for some infiltration before discharging to the stormwater pipe.
Staff Recommendation
Staff recommends approval of the Site Plan Review with the following conditions:
1. This Site Plan Review approval shall be subject to the recording of the Plat of Hamel
Commons;
2. The Applicant acknowledges that City ordinances have identified future residential use
for portions of the property and that future new construction or development may be
required to provide residential units, consistent with the ordinance requirements in place
at the time of such construction or development;
3. Proposed trees shall be no more than 25% from a single species;
4. At least three percent of the area of the parking lot shall be landscaped;
5. The Applicant shall utilize architectural elements such as windows, spandrel glass, or a
differentiation of building material or design in order to break up the monotonous
appearance of the proposed addition;
6. The parking lot shall be located entirely outside of any drainage and utility easements;
7. The Applicant shall be responsible to ensure that loading, deliveries, and garbage services
do not impact traffic on Hamel Road. In the event the City determines that traffic is
impacted, the Applicant shall be required to construct necessary loading areas;
8. The Applicant shall abide by the requirements of the City Engineer review letter dated
June 2, 2009;
9. If proposed parking lot lighting exceeds 0.2 Footcandles at the property line, the
Applicant shall ensure that lights are extinguished while the business is not operating;
10. Sufficient area shall be provided in the trash enclosure to contain both trash and recycling
containers;
11. The proposed enclosure shall be of sufficient height to fully screen the dumpsters in the
trash and recycling area;
12. The Applicant shall use fiber cement lap siding which is impregnated with a color to
match the existing building;
13. The Applicant shall obtain written approval from adjacent property owners and from the
railroad in order to complete any work which extends off of the Property;
14. The Applicant shall be required to obtain a liquor license and abide by relevant
requirements in order to operate a liquor establishment;
15. No outdoor seating is identified on the site plan. Any future request for outdoor seating
shall be reviewed by City staff; be entirely contained on the property; be no larger than
200 S.F.; be fenced to control admission; include steps to limit the impact of noise and
lighting; and count towards the determination of sewer and water connection fees.

Wrangler's is looking to get approved to open a new restaurant/bar in the Uptown Hamel area in the old
Providence Antique Shop. We have purchased that property the one directly behind and the property to
the west. We are asking the City to let us join these three pieces of property together so we can add a
parking lot, beer cooler, new mechanical and dumpster area. The new restaurant will be a medium
priced facility seating approx 35 specialized in serving high quality food and beverages (we have
attached a copy of the menu for your viewing). We will also be offering entertainment such as pool
tables, video games, pull tabs, live music, DJ and karaoke. The theme of the restaurant will be western
in nature as we are hoping to fit into the surrounding old town Hamel atmosphere. We our committed to
making this a fun and enjoyable place that anyone can come into and have a good meal and a good
time.

SUBJ: Ordinance Amendment: Rural Residential Animal Unit Density Standards
Background
On October 7, 2008, the City Council amended the City Code and added animal unit density
standards to the rural residential zoning districts. After administering and enforcing these
standards for approximately six months, staff noted the need for further interpretation of the
regulations, and potentially the need for amendments to the requirements in order to achieve the
intended goals.
The City Council discussed the subject at their April 21, 2009 worksession, and the Council
provided comment and directed staff to prepare ordinance updates for Public Hearing and
Planning Commission review.
Existing Regulations
The animal density regulations for the Rural Residential (RR) zoning district are contained in
Subd. 8 and 9 of Section 826.25. Regulations in other rural districts are essentially the same.
Subd. 8. Animal Unit Density Standards. Livestock or traditional farm animals are permitted
on properties two acres or larger at a maximum density of one animal unit for the first two
grazable acres of land and one additional animal unit for each grazable acre of land thereafter.
For properties less than two acres, the maximum number of animal units shall be 0.1. Property
owners shall be responsible for management and proper disposal of all animal waste. The
number of permitted animals shall be determined by the following table:

The number of animal units for animals that are not listed above shall be determined by taking the
average weight of the animal in pounds and dividing it by 1000 pounds.
Subd. 9. Animal units in excess of those permitted above may be allowed by conditional use
permit, subject to the conditions of Section 826.98 Subd. 2 (o) of this ordinance.
Section 826.98, Subd. (2)
(o) Sites which exceed the number of animals allowed under Section 826.25. Subd. 8:
(i) minimum lot size is 10 grazable acres;
(ii) all animal feed and bedding must be stored within an enclosed building;
(iii) the size of the barn or stable shall be suitable to the total number of additional animal
units requested under this conditional use permit.
(iv) the subject site shall incorporate various Low Impact Design (LID) features and/or Best
Management Practices (BMPs) that provide for the most effective means of manure
management, such that no net increase in runoff occurs from the site, as determined by
the City Engineer.
(v) the subject site shall construct a concrete manure containment or composting area, the
design of which shall be consistent with the recommendations of the University of
Minnesota Extension Service. Owners shall provide a schedule for removal of manure or
compost from affected sites, subject to the approval by the City.
(vi) a grading plan shall be submitted and approved by the City in accordance with the
recommendations of the University of Minnesota Extension Service and approved by the
City Engineer. Said plan shall clearly demonstrate that storm water runoff from the hard
surfaces on the property is directed away from the stable areas and manure containment
facilities, and surrounding wetlands, streams or lakes (if any) and the site must maintain
these drainage patterns to the satisfaction of the City;
(vii) the site shall install runoff retention and vegetative infiltration systems, consistent with
the recommendations of the University of Minnesota Extension Service and as approved
by the City, down slope from the stables and manure containment area. The vegetation
adjacent to any wetlands shall be subject to the city's wetland protection ordinance;
(viii) diligent effort shall be made to prevent the cribbing of trees in or near pastures, and
efforts to maintain grass in the pastures by limiting use thereof as appropriate and by
providing supplemental feed to prevent over grazing by instituting a pasture
management program in accordance with the recommendation of the University of
Minnesota Extension Service and as approved by the City; and
(ix) the city council may require compliance with any other conditions, restrictions or
limitations it deems to be reasonably necessary to protect the residential character of the
neighborhood.
Existins Definition of "Grazable Acres"
The regulation limits the number of animal units based on the amount of grazable acres on a
parcel. This term is also defined in Section 825.07 of the City Code as follows:
Grazable Acres. Open lands consisting of pasture or other vegetation which can support grazing
by livestock or farm animals. For the purpose of this subdivision, the number of grazable

acres on a property shall be determined by a survey, which shall exclude any existing and
proposed hardcover and wetlands.
Staff has interpreted this definition to subtract wetlands, hardcover and wooded areas from the
total area of a property.
Reaction to Animal Unit Density Regulations
Over the past six months, the most common situation in which staff has been faced with
questions about the new regulations is at time of a property sale. A realtor may, but certainly
does not always, call and ask about the City's regulations on animals. When the City has
received these calls, staff does not have accurate information on wetland boundaries or areas of
woodland. As a result, staff cannot provide an answer to the question "how many horses can I
have on my property."
Staff has access to aerial photographs, and general wetland information without delineated
boundaries. It is possible to give a very rough estimate of grazable acres from this information,
but it is admittedly inaccurate. Property owners and potential buyers have both expressed
frustration at this fact.
In order to get accurate information, the ordinance requires that grazable acres be established by
a survey, and in order to accurately find a wetland boundary, a wetland delineation would have
to be completed. This process likely costs more than $4,000-$8,000 and cannot be completed
from November through April of every year.
Property owners have expressed surprise and concern that certain areas of their property are not
counted towards the amount of Grazable Acres when they have historically grazed animals or
grown hay in these areas during large portions of the year. These areas are often seasonally
flooded basins (which are wetlands) with reed -canary grass. Potential buyers have expressed
surprise that the new regulations permit less animals than there are stalls for in existing barns.
Staff has also noted a difficulty in interpreting the "open lands consisting of pasture or other
vegetation which can support grazing..." Generally, staff informs callers to exclude wooded
areas which do not support grass.. Again, this is very difficult to estimate from aerial
photographs.
Current Regulation Potentially Acts as an Incentive to Remove Trees
One of the primary reasons that staff wished to discuss the animal density regulations with
Council is because staff was concerned the regulation could potentially act as a strong incentive
for property owners to remove trees. This is as result of the number of animal units on a
property being based on Grazable Acres, and Grazable Acres excluding wooded areas.
While the City has adopted tree preservation regulations, this is only applicable to significant
trees (over 8 inches in diameter). Additionally, the ordinance allows removal of approximately
15% of the significant trees.
Staff has had property owners and potential buyers state that they would clear wooded areas in
order to create additional Grazable Acres so that the allowed number of animal units would

increase. This activity would be subject to the Tree Preservation ordinance if there would be
more than two significant trees in the area.
The City Council discussed this issue and determined that the Tree Preservation ordinance is a
sufficient protection against widespread clearing. In other words, a limited amount of tree
removal is acceptable in order to achieve the goals of the animal density standards.
Regulations in Other Communities
Many communities have a maximum animal density standard. The existing regulations are fairly
similar to those in these other communities. Many communities use the "grazable acre" term
with very similar language to the current language in the City's code.

Administrative and Enforcement Difficulties
Staff has noted difficulties in administering and potential difficulty in enforcing the animal
density regulations in the future. This report has already discussed the difficulties with
calculating Grazable Acres and the potential impact on property owners.
Staff does not believe the intention of the ordinance was to require every property to
immediately report the number of current animal units and the number of Grazable Acres to
determine which properties are in violation of the requirement. Presumably, the City would
enforce the regulation upon a complaint or witnessed violation. The alternative would be to
require licensing for every animal and an immediate determination of Grazable Acres for every
property.
The other issue staff wished to discuss was non -conformity. Generally, when a new regulation is
adopted, properties which do not abide by the requirements continue in the same condition, but
are not allowed to increase the non -conformity. Determining if a property conforms at the time a
regulation is passed is a bit easier when it is a physical standard such as a setback. When a
property owner would apply for a building permit to expand a building, the City can see what
exists and what is proposed. Additionally, the existence of a building is a fairly permanent
condition.
The number of animals on a property, on the other hand, is much more difficult to track. A
property owner does not need a permit to buy a horse. If a property is in violation of the animal

unit standard, the City would need to prove that the non -conformity was not increased after the
standard was enacted. Additionally, there is some question on how non -conformity would relate
to the mortality of the animals. For example, if a fire destroys a building which is non-
conforming in terms of setbacks, state statute allows replacement in the same condition if a
permit is pulled within 180 days. If an animal passes away, should the owner be able to
"replace" it within 180 days, or is the City going to tell them they cannot? There is obviously
extreme difficulty in tracking this information as well.
Alternatives
Staff presents the following possible changes for Planning Commission discussion. Some have
been integrated in the attached ordinance.
Add Purpose Statement
The City Council wished for the ordinance to include a purpose statement stating the reason the
regulation was enacted. Staff has provided language to this effect in the attached ordinance.
Count Type 1 Wetlands as Grazable Acres
When staff presented some of the issues discussed above with the City Council, the Council.
directed staff to prepare an amendment which would allow Type 1 wetlands to be counted as
Grazable Acres. A Type 1 wetland is a "seasonally flooded basin" which is usually only
saturated in the spring. One wetland basin usually includes different types of wetlands types.
Type 1 portion of the wetland is usually the outer edge. The map below shows wetlands which
likely have a portion of Type 1. The City's wetland engineer also cautioned that additional
basins may be Type 1 when they are actually delineated by an environmental engineer.

The City's wetland engineer stated that Type 1 wetlands throughout Minnesota are very often
farmed or grazed. Since they are dry for large portions of the year, there are fewer impacts than
in other types of wetlands.
Staff has included language in the draft ordinance which allows Type 1 wetlands to be counted
as Grazable Acres. Staff does note that in order to show which portion of a wetland basin is
Type 1, a property owner would need to complete a wetland delineation for review by the City.
Allow Properties Under 10 Acres to Apply for a CUP to Exceed Density Standards
Currently, the ordinance allows properties to exceed the density standards with a conditional use
permit. However, one of the requirements is that the property has over 10 acres of grazable acres
to qualify.
Staff recommends amending the ordinance to remove this requirement. Only large lots which
already would be permitted 10 animals could apply for the CUP. A person with 5 grazable acres
would not be allowed to apply for a CUP in order to allow 5 horses on -site. Staff recommends
amending the ordinance in order to allow more properties the ability to apply for a CUP. Staff
recommends an upper threshold for the additional animal units of 50% through a CUP. This
would give the City more of a basis to deny an application which is too high.
Update Language Regarding "no net increase in runoff'
One of the requirements to allow more animal units by CUP is to "incorporate various... (LID)
features...that provide for the most effective means of manure management, such that no net
increase in runoff occurs from the site..." Staff believes that the number of animals does not, in
and of itself, have an impact on the amount of runoff. Staff believes that the more important
issue is the amount of nutrients rather than the amount of runoff. Staff has recommended a
change to this effect in the draft ordinance.
Utilize Performance Standards Instead of Density Standards
Rather than regulating the number of animals on a property, another option would be to establish
performance standards which make it a violation to allow overgrazing to the point where
vegetation cannot be maintained or to maintain manure in a way which is a nuisance. The City
could then react to violations. This type of regulation allows more subjectivity than numerical
standards, which may be a concern. Since the City has already established a numerical standard,
staff has not altered the ordinance to rely on performance standards. However, staff wishes to
present it as an alternative.
Staff Recommendation
Staff recommends that the Planning Commission hold a Public Hearing on the attached
ordinance and discuss the issues presented. The Commission should then prepare a
recommendation for the City Council.

is 39 acres in size, with many areas of woods and wetlands. There are approximately 2.75 acres
of fenced pasture and 5 acres of lot without wetlands/hardcover/woodland. There are areas of
trees that do not include many significant trees. They could be cleared under the ordinance to
create more pasture. This property owner would not be allowed under current regulations to

units requested under this conditional use permit.

Best Management Practices (BMPs) that provide for the most effective means of manure

determined by the City Engineer.

design of which shall be consistent with the recommendations of the University of
Minnesota Extension Service. Owners shall provide a schedule for removal of manure or

recommendations of the University of Minnesota Extension Service and approved by the
City Engineer. Said plan shall clearly demonstrate that storm water runoff from the hard
surfaces on the property is directed away from the stable areas and manure containment
facilities, and surrounding wetlands, streams or lakes (if any) and the site must maintain
these drainage patterns to the satisfaction of the City;

vegetation adjacent to any wetlands shall be subject to the city's wetland protection

UTILITIES SPECIFICATIONS' AS PUBLISHED BY THE CITY ENGINEERS ASSOCIATION OF MINNESOTA (CEAM), EXCEPT
AS MODIFIED HEREIN. CONTRACTOR SHALL OBTAIN A COPY OF THESE SPECIFICATIONS.
1. ALL UTILITIES SHALL BE CONSTRUCTED IN ACCORDANCE TO CITY REQUIREMENTS.
2. CONTRACTOR SHALL NOT OPEN, TURN OFF, INTERFERE WITH, OR ATTACH ANY PPE OR HOSE TO OR TAP

SHOWN ON THESE PLANS IS BASED ON RECORDS OF THE VARIOUS UTILGY COMPAMES AND, WHERE POSSIBLE,
MEASUREMENTS TAKEN IN THE FIELD. THE INFORMATION IS NOT TO BE RELIED ON AS BEING DOM OR COMPLETE.
THE CONTRACTOR MUST CALL THE APPROPRIATE UTILITY COMPANY AT LEAST 48 HOURS BEFORE ANY EXCAVATION
TO REQUEST EXACT FIELD LOCATION OF UTILITIES. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO

THE CONTRACTOR SHALL TAKE ALL PRECAUTIONS NECESSARY TO AVOID PROPERTY DAMAGE TO ADJACENT
PROPERTIES DURING THE CONSTRUCTKIN PHASES OF THIS PROJECT. THE CONTRACTOR WILL BE HELD SOLELY
RESPONSIBLE FOR ANY DAMAGES TO THE ADJACENT PROPERTIES OCCURRING DURING THE CONSTRUCTION
PHASES OF THIS PROJECT.
SAFETY NOTICE TO CONTRACTORS: IN ACCORDANCE WITH GENERALLY ACCEPTED CONSTRUCTION PRACTICES, THE
CONTRACTOR WILL BE SOLELY AND COMPLETELY RESPONSIBLE FOR CONDITIONS ON THE JOB SITE, INCLUDING
SAFETY OF ALL PERSONS AND PROPERTY DURING PERFORMANCE OF THE WORK. THIS REQUIREMENT WILL APPLY

THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROVIDING AND MAINTAINING TRAFFIC CONTROL DEVICES SUCH AS
BARRICADES, WARNING SIGNS, DIRECTIONAL SIGNS, FLAGMEN AND LIGHTS TO CONTROL THE MOVEMENT OF
TRAFHC WHERE NECESSARY. TRAFFIC CONTROL DEVICES SHALL CONFORM TO APPROPRIATE MINNESOTA
DEPARTMENT OF TRANSPORTATION STANDARDS.
I. ALL SOILS TESTING SHALL BE COMPLETED BY AN INDEPENDENT SOILS ENGINEER. EXCAVATION FOR THE PURPOSE
OF REMOVING UNSTABLE OR UNSUITABLE SOILS SHALL BE COMPLETED AS REQUIRED BYTHE SOILS ENGINEER. THE
